Hi all!! I'm a US citizen who filed I130 for my husband and step daughter in 2013. Their case was approved and they came to US in April 2015. As soon as my husband received his Conditional GC, he started torturing me mentally, physically and emotionally that I'd multiple miscarriage, abortions in 10 months. My family members were also abused and tortured. He was always abusive and ready to fight as soon as I came from work. He also talked to his ex wife everyday who is still using his name as her husband in all docs back home in India. When I tried to talk to him in regards to this, he said he only came here so that he can fulfil his dream to settle here and see his daughter become a lawyer. He had never worked ever since he came here. So he was dependent on me for the entire year. This year in January, he had sent his GC to USCIS to have his name corrected thinking he will get his perm GC ( he had his biometrics appointment on 02/19/2016 but not sure if he had received his GC yet). After that he tortured me a lot again and then one day in February I went to the police station and filed a report. Then I was advised to request for protective order which I did receive for 2 years. I came to know recently that he was in jail for about 20 days back in India for fraud and other crimes in regards to real estate property. I have reviewed other posts but not sure how to report him to the fraud unit on this basis and what documents to attach. Please help me!!!

I'm sorry about the situation you are going through and your family,

Correct me if I am wrong but before you report him make sure you have all the evidence you need cause if not there is nothing you can but divorce and try to move on from this

Presumably the jail time in India showed up in his police report.

Pretty sure torture is a criminal offence, what are the Police doing? Has he been arrested?

Presumably explains the initial police report from a local police station back in 2014 (pay off the cops; money can buy a clean slate in India) as opposed to a PCC from the Passport Office as required.

If you're trying to deport him, your best bet is to annul the marriage (on the basis that it was entered into under fraudulent pretenses and not a real marriage). You should also immediately report his physical abuse to the police, if he ever tries to hurt you.

However, the charges and proof will have to be serious and bona fide. Talk to a lawyer and tell them the facts, and the lawyer will advise you whether you have a case for annulment, or not.

However, even if it's only emotional abuse you're dealing with, it's enough for you to walk away. If not annulment, then divorce. Do it fast, and move on. He'll be able to stay, but he won't get a chance to torture you again.

I was wondering how long it would take for someone to mention annulment :idea:

You have a restraining order. Divorce, put it down to experience and move on. It doesn't look like you have much evidence against him and you seem vindictive.

He will try to remove conditions on his own. Leave him to his fate.

EDIT: If you have 'legal proof' that he was convicted in India for fraud, you may be able to have him deported for lying on his application. He obviously managed to clear the background check by getting phony papers.

I have a friend who was in a very similar situation in 2013. He came to the USA with a K1 and walked out the door within 2 months of his arrival. Since then he's been living as an illegal, right out in the open with no worries about deportation. He lives with a group of other illegal aliens from his country and works in a pizzerea, collecting his income under the table, which means he's paid cash and doesn't pay taxes. It's been 3 years and my friend is still relentlessly trying to convince our government to do something about this man. No-one is going to do anything whatsoever about him. Uncle Sam could not care less. People who want to use relationship fraud as their method to get into the USA study up on the details of the process and they know once they get here, they're going to be in the clear with no fear of deportation. Just divorce the snake and move on with life.

You never know, many under the table workers do indeed file their taxes in hope of immigration reform someday where it may help them (ie: possible dapa). And you're likely right, unless a crime is committed most likely nothing will happen.

with over 10 million illegal aliens, ICE would need a budget that is 50 times larger than they now have to handle the problem. There isn't the will in Washington to spend this kind of money. Besides both parties get some votes pushing their divergent solutions with the public.
