Some foreign U.S. consulates require a 2nd affidavit of support which is called "sponsor's financial responsibility

under the social security act." It is a simple form and easily filled out and signed. The Hong Kong consulate does

require this form, as does the Sydney (Australia) consulate.

My question is, what is this second affidavit of support the quote is talking about?

I've gotten my I-134 form complete and my co sponsor has everything complete/notarized as well.

I just ran into this just now and I am wondering what that form is?

It says it is a "simple form and easily filled out and signed" Since we're going through the Sydney Consulate I'd like to know what this is before I send my whole packet of information to my fiance.

Is this 2nd affidavit just my I-134 and my co-sponsor's I-134? If this is the case, do I have to meet the requirements as well? (Cause I won't lol) So, do I need another co-co-sponsor? (I know i made that word up). If it is another form, where do I get it?

02 - 13 - 2007 - NOA1 Received

02 - 21 - 2007 - Touched!

03 - 01 - 2007 - NOA2 Received

03 - 02 - 2007 - Touched Again!

03 - 06 - 2007 - NVC Received

03 - 07 - 2007 - Was told by email I-129F will be forwarded to Sydney

03 - 08 - 2007 - I-129F picked up by DHL and on it's way to Sydney!!

03 - 12 - 2007 - Sydney Consulate received packet! From DHL: 1:48 pm Shipment delivered WOOT

03 - 19 - 2007 - Packet Three is sent off!

03 - 20 - 2007 - Corey goes to get his fingerprints/police check completed. Now we wait for the investigation and then I can be assured he's not a criminal =]

03 - 21 - 2007 - Corey gets Pkt 3 via Registered Mail

03 - 22 - 2007 - Sent Corey a copy of all the documents and the notarized I-134.. hopefully everything arrives safely!

04 - 17 - 2007 - Corey's Medical Examination.. Let's hope everything goes great!

05 - 01 - 2007 - Corey's Medical Rescheduled to this date because doctor was away!

05 - 04 - 2007 - Corey's Initial Interview date! (We only had ONE week's notice!)

05 - 30 - 2007 - Corey's Rescheduled Interview date because there was no time for the initial one

That's not a 2nd affidavit of support, it's a form by which sponsor's acknowledge having been informed of their responsibilities and obligations. Not all consulates use the form, but they are supposed to in cases that involve an I-134.

Thanks for the quick response.

(9 FAM 40.41 (Public Charge) Procedural Notes, PN5 is all the way towards the bottom of the pdf).

I understand that it states the responsibilities of the sponsor and how we're held responsible if the beneficiary becomes a public charge.

But in my quote in the first post, it says that it's a form that is easy filled out and signed. Where do I get this form so that we can sign and acknowledge we understand our responsibilities? Because it also says:

"You may not accept an affidavit of support for purposes of INA 212 (a) (4) unless the designated form concerning Social Security Insurance (SSI) benefits is signed by the sponsor(s) and attached to the affidavit."

I promise I'm trying to do my own research before asking these questions. I've tried to google what the status of INA 212 (a)(4) stands for but I couldn't understand it.

Because we'll be applying at Sydney (one of the consulates that VJ guides states requires a "2nd affidavit of support") I'm wondering:

1) Do we need to fill out one of these forms?

2) Does this INA 212(A)(4) apply to us if this form only applies to INA 212(A)(4) sort of applicants?

3) If it does, where do we find this form to fill out so we can download it and fill it out and send over to my fiance all at once with our other documents?

did you get a reply to the 2nd affidavit of support question you had and what form it involes?

I'm also going to be going through the sydney consulate when we get our NOA2 and would like to have most of the information and forms gathered and good to go.

Like you i don't want this to become a hurdle.

I saw the same thing you did, and had the same question you did. It is form DS-1858 - Sponsor's Financial Responsibility Under The Social Security Act. I got a scanned copy from http://www.visapro.com/US-Immigration-Forms/Form-DS-1858.asp but maybe you can find a better copy somewhere on the net. I sent it to my guy just in case.

ohhh elw, you're a lifesaver. But I had already sent everything off 2 days ago.

Because no one responded with an answer that I could understand..so I just kinda ignored the whole second affidavit. I was thinking I would just deal with it when the time comes up.

But its better late than never that you found that!
