Mirror court orders.

I don't want to go into it in huge detail on here. But long story short, I have a court order stating my daughter lives with me, I have permission to move with her and that I can apply for her passport. I have all the court documentation and was advised to apply for a mirror order. But because England doesn't give 'custody' I am wondering what exactly they could put in place when I apply in the US. Her dad lives 4 hours from where we are in a different state and his environment is not suitable. He hasn't seen her for more than 4 years and she is 8. Has anyone actually done this? I'm assuming our situation is a little unusual. Currently I have paperwork saying that visitation is suposed to be supervised, but he isn't happy about it.

Her dad is American and you will be moving over there albeit to marry someone else. I would think you might need to consult with an American lawyer to get things legal once there. Surley the fact that you will both (her dad) life in same country will make things easier. Maybe ask your American Fiance to make enquiries at his end as to what is required, you have the court notarised documents from England so that will help surely with American legal system.

Thats what I think too. But because he's currently homeless and keeps changing his job, if he wants her at his house that he gets eventually it concerns me. He has a history of living with unsavory characters.

Which explains the supervised visits. I think when you get to America consult a lawyer there, they can mirror the court orders made in uk or adjust maybe - that's something only you and a lawyer can decide on. If your fiance can look into it before you get there it may help cover some ground, Your ex lives in a different state that may play a factor in it as well..

I think so. I'm currently gathering any paperwork I'll need for the attorney so when we go see him after I move we can find out more.
