Hi all,

I finally figured how to post a topic on here!

Im a US citizen but been resident in Nigeria for a few years. Ive been wanting to move back to the US but didnt want to leave without my spouse who wasnt inclined to moving at the time. Now we want to move and i have a few issues:

Filing for him requires W2s which i do not have. He has been supporting us both for a while, while i tried bringing my business back up...and failed. After moving, he'd still retain his job, so he can provide the Affidavit of Support. Will this work? Can we get a K3 while at it then prove support when we both get to the US?

I think we'll also need to prove im moving back by taking employment or buying property. Taking employment requires me leaving him here which im not a fan of. That's how my parents split up in the 80s. Buying property requires more money than we have currently..

He has applied for MSc and will are preparing for that. Is it better for him to move as an F1 and file AOS when we get there? He'll be a student regardless of manner of entry. Somebody help.

Entering on a F1 with intent to AOS is fraud - so don't do that. Also very doubtful that your embassy (Nigeria is considered high fraud) would grant a F1 to a person married to a USC.

K3 hardly gets granted anymore - concentrate on the CR1/IR1 application.

Have you filed your taxes while abroad?

If you (the USC) have no income, you need a co-sponsor that currently resides in the US. Any family members that could help you?

Depending on the circumstances (and local requirements), you might have to live apart for a shorter period of time. Fortunately, communication technology has advanced greatly since the 80's :-)

If it isn't difficult, it isn't worth it.

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

Thanks for the swift reply. I figured itd be a problem if i'm listed on his F1 application as spouse considering the problems Nigerians face and present at the consulate. Ive been reading about the K3 taking as much time as the IR. Oh well. That's that.

I have family members that may help.

It's required that we both travel together (at the best options) or i go before, at the least. I filed taxes for some years then my income fell way below the required level. Sigh.

Finances are getting back to a place that can get us both to US and get our lives on track.

Communication Technology has advanced but..but..but... :'(
