Hello vjers, the new problem i have with the k-1 process is that my NOA2 expires on 4/20/07 and today when i checked mumbais interview schdule for April which is posted on the 15th of every month, my case number is not listed. The thing is that for some reason the consulate recieved my packet 3 on the 21st of feb, but they did not enter it into there sytem untill March 13th. Is it possible that i will be schduled in April still and just was left of the list????

There may be someone on here that has personal experience with that embassy but I can tell you the reply I've seen every time this question has been asked, because I've asked it myself too and that is the embassy will take care of extending the expiration of the petition approval. I'm sure other VJ'rs will chime in here and tell you the same thing so I wouldn't worry about it.

41.81 N6.2 Validity of a K-1 Petition (TL:VISA-581; 09-03-2003)

An approved K-1 visa petition is valid for a period of four months from the date of Department of Homeland Security (DHS) action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States. However, the longer the period of time since the filing of the petition, the more the consular officer must be concerned about the intentions of the couple, particularly the intentions of the petitioner in the United States. If the officer is not convinced that the U.S. citizen petitioner continues to intend to marry the beneficiary, the petition should be returned to the approving office of DHS with an explanatory memorandum. [see 9 FAM 41.81 PN7 for revalidation procedure.)

My NOA2 expires soon with an interview date yet to be scheduled.....when I inquired about this I was told that the expiration date is automatically extended by the consular officer if you haven't yet been scheduled for an interview. Email your embassy, they should tell you the same.

I wrote in a request for extension and followed the guidelines under example forms request to extend.That way I would have a "formal" request I also copied that request and sent it via email to the consulate and to my finacé along with a "hardcopy" to the consulate just so my butt was covered. That way I could prove to them it was important to me, that it was extended. I am the USC.

The consular officer can revalidate approved petition for the additional period of four months from the date of revalidation. Once your fiancé has obtained all required documents as listed on the checklist, please fax your checklist to schedule an interview appointment.Thank you. UNQUOTE

I agree with others here about the NOA2 validity - probably you don't need to do anything and it will be automatically revalidated by the Embassy; however if it makes you feel better, you can submit a written request.

Most likely you were NOT just left off the April interview list; check out the Mumbai timelines here on VJ. Usually interviews are scheduled for 2.5 - 3 months after receiving Packet 3, slowest in India. (Chennai being the quickest at about 6 weeks - they schedule the interview immediately upon receiving the case from the NVC - and Delhi being in-between at about 2 months).
