Proof of income with affidavit of support

Timeline

Hey all,

So when I go for my interview with the affidavit of support my fiances father signed, what proof of income is good to use? I think he'll likely be uncomfortable with sending his tax transcripts and stuff, I know you can use a letter of employment from his employer - is there anything else we can use thats less intrusive than tax returns?

K1 Fiance Visa:

02/03/2016: I-129F sent

02/11/2016: I-129F petition received at Dallas

02/17/2016: NOA1 emailed and text

02/23/2016: Hardcopy NOA1 received

04/07/2016: NOA2 approved

04/12/2016: Hardcopy NOA2 received

Tax transcripts or copies of the complete tax return is required. There is no way around it.

From the instructions

18.a. - 20. Federal Income Tax Return Information

You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your
Federal individual income tax return for the most recent tax year
. If you believe additional returns may help you to
establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual
income tax returns for the three most recent years.

Although most embassies require tax transcripts, I hear (and others may confirm or correct me) that the London embassy actually prefers a letter from the employer stating salary. Maybe he could also give you some copies of his recent pay stubs?

Otherwise, bringing a sealed envelope with the tax transcript is also a good idea. Redacting his SSN (if that is what he is worried about) I hear is also ok.

If it isn't difficult, it isn't worth it.

The I-864 will not be considered valid without it. Each embassy has a different attitude toward cosponsors for the K-1. They do not have to even accept them at all. They can see you have plenty of income and still deny based on inability to support the beneficiary. There are no fixed rules stating what they have to accept or not accept with a K-1 applicant, it is completely up to the CO's judgement call or the local consulate's policies. This is why many use the I-864 rather than the I-134 when using a cosponsor for a K-1. It shows the cosponsor is serious and will be there when the AOS application is made.

IN LONDON at a K1 interview they want the Form I-134 from the person sponsoring. In this case it will be from the petitioner's Dad. LONDON does NOT require a tax return or tax transcript as proof. You may provide them with any form of evidence that shows the income. Suggestions are:

A) an employer letter

B) 2015 tax return/W2 or tax return transcript

C) 3-6 months recent pay stubs.

D) statements showing assets in lieu of having an income producing job

If he wants to keep his income confidential, he can mail his I-134 and income document straight to the IV Unit of the embassy, making sure to include your identifying names, birth dates, LND number, interview date, and state is in support of a K1 visa

Or he can seal it well and mark it "To be opened by a US Consulate official only". Then he can mail it to you (in an outer envelope) to be taken still sealed to your interview.

So if my mom is acting as a co-sponsor, will my fiance need Form I-134 and all of the documents that go along with it for both me and my mom or just from my mom? I am a full time student and have a job, but I do not make very much annually.

They will need them from both the petitioner and the co-sponsor. The Petitioner is always the primary sponsor, even if they have no or little income.

Not for a London interview. They accept the I-134 from ONLY the person with Income. The fiancé does not have to do an I-134 for LONDON.

When you adjust status, the I-864 affidavit of support has stricter rules outlined in immigration law. The new spouse will do an I-864 even with zero income.
