Hello guys,

This forum has been very informative but I was unable to find an exact answer for my unique situation. I would appreciate any advice on this

I have spent the last year and a half living with my husband in the United Kingdom. Now I am back in the USA and wanted to submit the paperwork. I am not working currently because I just came back from the UK and also am pregnant. I am living with my brother who is going to be sponsoring me. I understand that even though I have no income I still need to still submit an i-864 from my side but I had the following question:

1. My question is, is it better to have him listed as a member of the household and therefore fill out the 864a....or should he fill out a separate i-864 even though we live in the same house? His income is sufficient but he files jointly with his wife so he would prefer to show her income as well on there (if possible...but not major concern)

2. Also, if he does submit the i-864, and his wife submits the i-864a, in part 1 would he select 1.d (he is the only joint sponsor) or 1.e (first of 2 joint sponsors)?

separate because you aren't combining income

his wife will submit the i864A only if he needs to combine income with her

hey thanks a lot for the help :)

so even though we live in the same house, him and his wife do not count in my household size, correct?

He counts himself, wife, immigrant (and any children they may have)

Your form counts yourself and immigrant.

You are independent adults that happen to share the same address.

He is "the only joint sponsor".

On a side note, your process filing from the US will take about a year. Had you remained living in the UK, you could have filed with USCIS in London and cut that time in half or more. it's called Direct Consular processing and goes much, much faster.
