Hello. We withdraw our i-129f petition not yet approved over a month ago. Our approval estimation date is passed and people after us got approved while our status is unchanged. We didn't get a response yet. I would like to enter using ESTA in the summer to be with my fiance for a short visit (we're not planning to get married yet). Can I do it or will I encounter problems?
In case for some reason they denied the petition (let's hope not!) instead of withdrawing it can I still use the same ESTA?
As I said, it's just a petition, I didn't get so far as applying for the visa.
Thank you.

If your application is denied you must update your ESTA VWP. If you don't update it then you might end up in more trouble at POE.

Sounds like your wanting to just use your VWP to go over to the states and Adjust your status.

No I don't want to adjust. The whole point of our withdrawal is that we want to wait. We will probably not even getting married in the states. I just want to see my fiance. Then eventually file for either cr1 or ir1 once we're married. But technically would not be a visa denied just a petition, should I update it either way?
