Do a K-1 instead.

Depending on your fiance's home state, you could do a proxy marriage whiles you are in the US. Some states don't allow proxy marriages.

But before anything, neither process is going to grant you a visa in less 3 months. You will living here for 1 year by yourself until he returns. That's something to think about.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I came to the US on a B2 visa and fell in love with a soldier. Before I came back to my country, we got engaged.

My question is : Would it be possible for us to do "marriage by proxy" and then file for a K1 visa?

I have done a mini research and found out that unconsummated proxy marriage is recognized by all states (except one), but not by the USCIS. It also stated that the beneficiary can be petitioned as an alien fiancee.

We won't be able to see each other after the proxy marriage (should we pursue it) as he is deploying in a month or two for a year. I'm worried that a military expedite request might not be granted cause we will only have less than two months left by the time our petition is ready to be filed and it is impossible to have a k1 visa on hand within that span of time.

Military benefits would be such a great help as we prepare for when we start our lives together.

What do you see as the biggest benefit of a proxy marriage in your situation? Is it so he can draw additional benefits from the military while deployed? If it is, the warning about it looking like fraud is something to be very wary of. From what I've heard of proxy marriages and immigration, it seems to be much simpler to file for a k-1 without the proxy marriage (since there's no time for a in person marriage) and arrive at the end of his deployment. But if your ideal plan is to marry by proxy, file the k-1, have it approved, and move to the USA as soon as possible, I think it could be a very lonely (and hard) year in a new country without your fiancé. Do you have friends to stay with? If not, who's going to help you with the basic things (like getting to a store until you can legally drive)? Also if a proxy marriage is not good enough for a CR-1, would it be good enough for the USCIS to count as being married within the 90 day window to qualify for AOS if it wasn't consummated during that 90 days?

Proxy marriages that we have seen on VJ have had tremendous amounts of problems being approved. In fact the majority are not, even with all sorts of help.

A lawyer isn't going to make it any better so don't spend your money for nothing.

Read the other thread linked above as well as use the search feature for other proxy nightmares.

I think we will skip the K1 visa. I have a B2 visa and can come back to the US anytime. Thanks.

Texas. We lived together on my recent visit for 6 months. Also, I have been in another foreign country for 2 years by myself, with no relatives and when I arrived, I didn't have friends. 1 year in the US without him would be easy as I have family in 5 states.
