Proxy Marriage and CR1 visa

Hello,

I was in Morocco recently to issue my marriage with my Moroccan fiancee, but because of the lengthy process I could not stay till it the process was done.

I was advised to do a power of attorney to her brother to sign the marriage certificate on my behalf. Is that considered a proxy marriage,even though I was there most of the process?

Does USCIS accept this kind of certificate as a marriage evidence when I submit the petition for the CR-1 Visa?

Please help!

I don't think that it's a problem. The only issue is that they might ask for evidence like pictures of you guys. I think the best thing is to get an attorney's opinion on this. But I doubt it's a problem, just be ready to provide a lot of proof for your legit marriage. Good luck with everything.

Were you considered married before getting the marriage certificate signed, normally that is not the case. I would have thought you did a proxy marriage, from what you have described.

Who May not file this Form I-130?

4. A husband or wife, if you and your spouse were not both physically present at the marriage ceremony, and the marriage was not consummated.

even though I was there with her for 3 weeks doing all the paperwork? It''s not like we never met. we met 2 times and spent almost a month together!

Having met isn't the issue, the issue is with following the rules for this kind of visa. This visa requires that if you weren't present for the marriage then you need to consummate the marriage prior to filing the form.

The rule is that a proxy marriage must be consummated before the I-130 can be submitted.

Can you return to Morocco or meet your wife in a third country so that the marriage can be consummated?

I just got back from a 3 week visit. I could not imagine all that went in vain. :(

Do you or anyone know or advise what my options are at this point to do the visa process? ( As of now we are given the permit but have not yet issued the marriage certificate - waiting to see what our options are )

I just got back. I am afraid I can't due to my job. :(

This is the best thing you can do now, take loads more photos. Hell, considering the issues others have had with the proxy marriage I would recommend to take a photo with a newspaper from the day you see her again to show you saw her after the proxy marriage. Edited by Illiria

hey guys, if it makes any difference, " I made the power of attorney while I was present there with my fiancee and in front of the lawyer. It is not like I sent it from here through the embassy or anything. It was made by me in Morocco and mentioned in it that due to my travel arrangement I had to leave before the papers were issued. "
