AOS/ January Filing Date Question

Good morning,

We filed for 485, 765, 131 on January.

We received the NOA that they had received our paperwork and then we have not heard from them. On the uscis website under the 485 it says since January..

On January 19, 2016, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSC###... Our National Benefits Center location is working on your case.

But then we haven't heard anything else.

Should I worry? Or are we still on our timeframe?

I would definitely put in a service request.

As for further action, people seem to mention contacting a congressman a lot on these boards though I'm not sure if it's too soon for that. I'm sure someone else will be able to advise you on that but in the meantime, absolutely put in a service request. I know for the EAD you are eligible to do so after 75 days which you have passed.

Why would you put a service request in? The page clearly says to wait 6mos before asking a request. I think some people that panic help slow the entire system down that people get so upset about.

The EAD/AP you should have probably heard something by now hopefully as they typically are done in 90 days and the biometrics appt is done before that...but thats not the 485.

You can also search the forums for the JAN 2016 filers to see others experiences more explicitly than the less granular timelines.

A review of the applicable timelines shows you are certainly well w/in the bell curve..

They have your case. You dont have an RFE. Relax.

Please be a little nicer next time you are responding to someone. No one is panicking and no one is slowing the entire system down. It was a simple question as to what to do or how to proceed.

And no you are wrong I have not heard anything from the EAD/AP either and yes it has been more than 90 days..

So now I ask you.. I should send a request for the EAD right? Since I have not heard anything from them neither have I done my biometrics appointment.

I always research before posting a silly question, but in this case it was just for extra information.

Because as you said, the EAD/AP she should have heard something about and at 75 days, you are allowed to put in a service request. Her AOS is obviously well within the timeline. That could be another 3-6 months easily however, the EAD/AP is rarely outside of 90 days.

The EAD/AP combo card can take 90+ days, some go over, I did.

You can send a service request after 75 days.

Notifications aren't done until card approved so you are within the usual timetable.

Since you have not even had your biometrics appointment, you need to contact them. You cannot receive an EAD or the green card without having biometrics done for them. The bio appt. letter is usually sent around a month or so. If possible, make an infopass appointment and take your receipt notices from filing all 3 forms. Let them know you have not heard anything, and have not had your biometrics done yet.

Looks like you haven't done ur bio appointment so I would focus on that first, you should have received it by now, if you waiting over 40 days which you have call USCIS and have them reschedule you for it as more the likely you missed it by now and if you miss your appointment it's a automatic denial, so call them the sec you they open cause without the bio you will not recieve green card or the EAD/AP
