the problem is that you need to send proof of bona fide marriage with the i130 for it to be approved

that's why in your other post, which is the same, I said that if I were you, I'd wait a while, but it's your choice

i'm applying now just for we thought was better to do it before my 90 days run out and we was hoping to from now to the interview we will be ready in our own place and have build together enough documentation to proof our relation is for real....now i don't know what will be better....to stay and wait not matter if i'm out status and get our own place and stuff first or apply now and build things from now to the interview???

ok...i understand....we can get fidavi from his friends and me from my family, we have the photos of wedding and going out here...you don't think that can be enough just for now still we can get a house and the other stuff??

Maybe it would be easier (and cheaper) for him to move to Australia?

Where did the sacings come from? You said it took you 4 years to save for the plane ticket? Now you have enough savings to pay thousands in fees?

is more logical if i stay here them him moving there....all my family is here...that is why for the last 12 year i come every 4 year and all his family lieve here and i never said i don't have saving there....i said it take me 4 year to come to visit for is really expensive to travel me and my kids for do it every year....i have a life there and business...i can't come every year and use all my saving every year....how them i keep living there but now to i decide to move here i can use my savings and the money of the sale of my assets there for build my new life here with my husband....after i divorce 4 year ago i was alone in australia just me and my kids, the last time i was here was after my divorce, now is the second time i arrive to usa after my divorce and was lucky to fall in love feel happy again...here live the man i love now, my family and his family....why would i want him come with me to australia or him will want to move to australia with me went both have more to gain here like have family around us....that is why been kind of easy to make the decision even if there my economic stability is better and the quality of life too, there have even less crime them here but now if my kids and i have the chance to build our life again by the side of a wonderful man who love me and i will be surround my family and my kids will be able to enjoy the joy of have their grandparents, aunts and cousins close by....why should i give up that?

You don't need to justify your actions or decisions to anyone on this forum. You have a legal path to staying here, so I'd work on getting that started and completed. Your posts are difficult to read; if you find the forms confusing then I'd hire a lawyer for help. Good luck to you.

I wouldn't rush to file if I were you. Yes, you'll be out of status soon but like others have said that'll be forgiven during AOS. You need to find a place to live with your new husband, get your SS number and start merging your lives before filing. Build up some proof. It won't take long, a couple months, and then you'll have a joint bank account and a credit card and maybe some utilities in your name to show you're living together. I've read here that things can get messed up if you move in the middle of the AOS process anyway. Might as well keep it as simple and straightforward as you can now.

It was a hasty decision but that doesn't mean you have to keep making hasty decisions.

Biggest problem will be the kids adjusting... new school, new lives... I imagine they left everything they own behind too thinking they'd be going back.

We decide to do what many ppl advice us here....we going to way to found a place and move and buid our life before doing this...and my friend in australia are boxing our personal stuff like my kids things to send it went we move to our new home here...thanks a lot for all the help and good luck with your journey....in the last few days i start all this i visualise how difficult it is and i start to question my self if just love is enough to quit my life in Australia to was not bad at all apart of the fat im far from my family to start a life here and be treated like a criminal just for fallow my heart...i love this man but i start to doubt if my call was the right call...if i really took a decision with my head logical or my under head base in the butterflies i feel went im with him...anyway...thanks for advice and good luck.

Are you an Australian citizen by birth, are your parents? It does not really matter in most cases but it seems to me like you may have moved to Australia at a young age for school/past marriage and adjusted and now are doing it again in the USA. I am by no means judging you but your story just seems a little off especially since your whole extended family lives in the USA. This will be seen as a huge red flag to immigration because they will see it as you are using your parents neighbor to gain permanent residency to be closer to the family. If your marriage is real make sure you have tons of evidence to prove that. Photos of your wedding with your family and husband alone will not cut it because there is no proof that your parents did not arrange this with their neighbor before you arrived for you to gain quick permanent access to the USA.
