Continuing Work on VWP (filed for our K-1 visa)

Timeline

Hello,

My fiance and I work for a global employer and we have submitted the fiance visa to move him from UK to the US.

Our company wants to retain him and said he can work for them when he moves. We haven't spoken to our company legal team to see if they really can do this yet.

My question is, does he have to quit his job when he leaves for the US? Then, wait 2-3 months for his EAD to be approved before he can start his job again as a US based employee?

Or, can that VWP (Visa Waiver Program) that the employer provided him allow him to continue work while we process his EAD and AOS.

AP/EAD Card Received in mail: 1/19/17

I-485 Approved (no interview required): 5/09/17

Green Card Received: 5/15/17

He will move on the k-1 visa, not the VWP.

If he works remotely while here and gets paid in GBP abroad, then that is basically a grey area.

He can not work as a US based employee until he has work authorization.

The VWP has nothing to do with his employer. It is a way for him to visit the US without obtaining a visitor visa. If he lived in China or Mexico for example, he would have to apply for a B1/B2 visa just to visit you in the U.S.

Timeline

Would he be hired by a US employer when he moves? If so, no. He can't work until he has his papers in order. And no, he can't work on VWP. First, he isn't entering the US on VWP he's entering on K1. Second, even if he did enter on VWP it's illegal to work on vwp... I don't see how the employer provided him with a vwp...?
