Long story short as I am getting ready to go drive to Boston airport.

---No stamp in passport that shows I-94 number for k1 visa

--No record at all that fiance has come here legally on the k1 visa (according to border control or w/e they call themselves)

--Me and then fiance are now married.

They stated due to having no record of us entering the country legally that the 90 days to get married hasn't even officially started, the problem is we've already gotten married after being in the USA for 2 weeks.

arrived by air yes. I had gone over to Uganda to be with her as she said goodbye to family and friends spent the month there in uganda and had gone to kenya with her as well for medical etc etc. we did everything the proper way.

We flew into Boston, went through immigration lines, guy took out our sealed envelope asked us questions put just an entry stamp with no number or anything in the passport.

Now that times come for us to fill out paperwork (AOS) now that were married and the I-94 is something we need so we spent all morning talking to different defered immigration officers, whove confirmed there's nothing at all in any system whatsoever with us coming to the USA

my worries is if they start the K1 visa now once this all gets fixed if it does were now married so it'd be an invalid visa. Man this is stressful

Timeline

You have been having some trouble with finding your electronic I-94 for some time. Suggest that you go to a CBP Deferred Inspection station with whatever documentation you have and get it straightened out. There have been several forum reports of misspelling, omission, confusion with people's names on the electronic I-94.

You will need a copy of I-94 for further AOS processing.

100% agree with newacct.

They should be able to sort it out at the deferred inspection, BUT even if they can't, she has a stamp in her passport proving legal entry & she is married to you. Worse case scenario, you AOS by filing an extra I-130.

You said she has an entry stamp so that proves she entered legally. The question is what status she was admitted into. The only obvious answer would be K1. Maybe they spelled her name wrong on the I-94 so you can't find it, or maybe they forgot to enter it into the system at all. They will probably sort it out when you go to the CBP deferred inspection office.

In the worst case, even if somehow she is not considered to be in K1 status (and I cannot imagine any conceivable way that could be), she could still AOS here by you filing an additional I-130, because she entered legally (and has proof).

I was thinking the same thing. even though you cannot find the I94 in the system she still has a stamp in her passport proving she entered legally. Best bet is to go to CBP with her passport and a copy of her boarding passes for the day she entered.

Timeline

The airline tickets, the stamp on the passport, and the boarding pass are your proofs of entry. Try to retrieve your I-94 online (cbp website). If its say that its NOT found, email the the detail of your entry and your information so that they may provide you the I-94. Better yet, go to the nearest CBP Inspection site near you and bring all the docs. During my AOS, the IO asked first for my passport but since I dont have it anymore, I gave the I-94 which he asked in lieu of the PP and took it. I guess he was just after confirming that I legally enter here (stamp on the PP). Get your I-94 to be sure though.

We had the same problem with MIL entry, we took passport, boarding pass and copy of ticket to CBP. It took us a week to wait, cause they only have one day a week to walk in to fix the I-94, and then it took them an hour to fix it.
