Have a couples questions for when we do our I864.

My husband (US citizen) has 3 kids who live with their mother we do pay child support;

I have 1 daughter who isn't sure yet if she wants to come with me there or stay here

Also another daughter who is mine and my husband together that will be living with us an she is a USC but is currently in Canada with me ...

When we are looking to see which amount he has to make to be over the 125% poverty line an it says for sponsors house hold size ... Which number do I actually look under?

Also if we use a cosponsor ... Do they combine their amounts or does one of them have to make over the line amount? Hope I'm making sense here all help is appceratied!!

how many dependents has your husband declared in his taxes? does he declare the 2 children that are with their mom?

if not, then they aren't included

if your daughter isn't coming with you, then she isn't included either

now, is your husband using a joint sponsor? please explain who the person is

He has only ever claimed our child on his taxes as his other kids live in with their mother an she claims them ...

Haven't figured out who the cosponsor would be as we weren't sure how many household personers we were looking at...

So would we be a 3 person house hold myself my husband an our daughter

Or because I am in Canada with our daughter now would it just be a 1 person house hold?

Actually the three children he has with another woman ARE included.

The petitioner includes, ANY children they have, no matter where they live and if they support them or not.

Your daughter would need her own petition so you would be included on her I-864 but she's not included in yours. Your visa category doesn't allow for derivatives.

Your household size as it stands right now is 6.

4 children and 1 beneficiary spouse. If your daughter comes it's 7.

A joint sponsor counts their household size... So themselves, their spouse, their dependents, and YOU.


If your daughter wants to move to the USA, she must be petitioned separately and have her own I-864.


Right now you're looking at $40,725/year before taxes.

Assuming the other children are minors they are counted no matter where they live. What are the ages of the other children?

If using a cosponsor do we send in an I-864 for my husband the petitioner an a I-864 for the cosponsor ?

To get the semantics out of the way first, joint sponsor is the proper term when referring to an I-864, not co-sponsor.

To answer your question, the petitioner and joint sponsor submit both submit an I-864.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
