Hello everyone,

I have a question..my husband moved to the USA 09/05 his 2 year visa will be ending 09/07...I have been reading and trying to learn the next step we must take..will the goverment send us some kind of papers to complete or is it up to us to send and complete them on our own? Since my husband has been in US we have not completed any paperwork. I have been reading about lifting conditions form I-751 and I understand it must be filed within 90 days preceding the expiration date on card but what about the AOS I-864? Do we need to complete this also?

thanks for any input,Starlett

Your husband is no longer her in a visa he is a LPR Lawful Permanent Resident.

The government will not notify you, you need to file the I-751, you do not need to file another I-864, the one that you used to get the conditional green card is the only one that you need to file.

This website has an excellent guide to lifting conditions.

The assumption here is that he arrived with a CR1. That information is not given by the OP. There is some evidence to suggest he is here on a K3 (2 year visa) and has not filed AOS ("Since my husband has been in US we have not completed any paperwork").

Yes I do need to stop that, I just looked at the poster's time line to try to see what type of visa they used to arrive and draw a blank there.

Not enough information in the post of timeline to help give a good answer.

YuAndDan,

Is he an LPR? How do you know. Starletth's post tends to indicate that he is not. From what she wrote it sounds like her husband probably entered as a K3 and has neither applied for an immigrant visa nor applied for adjustement of status.
