K-1 visa, and working during the process

Hi all, thanks in advance. I will give as much information as possible to make this easier.

I am 26 year old man in the UK and have been dating my Californian gf for 2 years (initially in Boston MA, then long distance from London). I previously worked in America then relocated to London.

The time has come for us to really take a step forward, so after trying to get a H1-b visa with various hospitals and struggling we decided to get married and then we won't have to live somewhere we don't want to etc as that was a reality.

So, is applying for a K1 fiancé visa the fastest way for us to be together and both work in the USA?

My fiancé is a pharmacist and I'm an optometrist. It's quite important I don't have a huge gap in my training and financially, we could survive for half a year on just her income but I don't want to put her through that.

Can I work in the UK while the K1 is being processed? And how soon after the marriage can I start work in the USA? I have a job lined up as soon as I have a work visa.

Thanks in advance. My fiancé is stressing quite a lot so I would like to put her at ease.

Of course you can work in the UK while the process is going on :)

Once you are married you'll file for AOS (which you can send in the EAD (work permit) and AP (Advance parole) the are free with the AOS) It take about 60-90 days to receive those two and a bit longer for the GC itself.

Yes you can work in UK while K1 is being processed. It takes approximately 90 days from filing for AOS (which is after amrriage) to get Work (EAD) permit to work.

So I will have to remain unemployed in the USA for 90 days until I receive my EAD? I will have to develop some hobbies!!

Your welcome!

Yes, but that is why I included the visa compare link. If you marry in UK and your spouse comes back and files the spouse visa you will be able to work right away as you get the greencard upon entry. No waiting around unemployed in USA. But those type of visas take a bit longer and you are separated after marriage. Less expensive than a K1 and you can work during that time in UK. Pros vs cons. It's a trade off.

CR1 seems a better fit.
