need help. 2 cases here.

I am helping my parents to immigrant to US now.

I filed both forms I-130 on Oct 2015. Now, I got $120 involve for my father from NVC. But my mom's application still in USCIS. When i check her case status online, it says the case is in local office right now. So how long I should wait. What should I do for my mom? Why these two cases have different processing time even though I filed at the same time?

Second question is about my friend.

My friend is US citizen. Her mom came to US before as traveler on 2009. And at that time, she tried to get a lawful status as resident through asylum or refugee but failed. So she went back to China after the court.

Now my friend wants to file I-130 for her mom. What should her do? Does her need to hire a lawyer or she can file by herself? What forms she needs at this point? She told me that since her mom can't get a green card before, if her mom tries to come to US through my friend's petition, she need to wait 10 years. Is that true?

since petitions are separate, they might have been separated and two different employees have the case, for your mom there is nothing but waiting

for your friend, if she lived here for more than a year and undocumented, she probably has a 10 year ban, if so, your friend will have to wait until the ban is up because there is no waiver

I just asked my friend, she told me that her mom applied to get green card as an asylum was happened when her mom was here almost half year. After her mom's case got denied, she came back to China. She said she went to see some immigration lawyer, some lawyers said her mom has 10 years ban, some lawyer said her mom doesn't have that. So can she apply her mom at this point?

to really know we would need dates,

when did she enter the country and apply for asylum? did she get a work permit to be legal while the asylum was in process?

how long did she stay after the asylum petition was denied?

she entered on Feb 2009 and applied asylum on Aug 2009. She got her SSN and work permit during the process.

She came back to China pretty soon after her case got denied. It was even before she got notice to appear letter from the court.

Is that information helpful.

If her daughter files I-130 for her, the question 16. 16. Has your relative ever been under immigration proceedings? how to answer this question? removal?exlusion/deportation?recission? or judicial proceeding?

But my friend's mom got a letter from Department of Justice Executive Office for Immigrantion Review Imigration Court. Order : The respondent shall be removed to China on the charge contained in the Notice to Appear.

Does this letter count as removal proceeding ?

Also, Could you please tell me that what is the meaning of immigration proceeding? Since she left voluntarily even though she got that letter, she would not have 10 years ban. and She is ok to apply for a green card through her daughter and she does not need to apply for any waiver, Is that correct?
