hi

if you were born in another country and one or both parents were USC at the time of your birth

if a USC qualifies, he or she can pass his or her citizenship even though the child was born abroad

you didn't send proof of citizenship?

Remember you do not need all of these things; if you have a US passport, that would be enough.

Is the biological mother a naturalized or born citizen of the US?

Are they asking for your birth certificate? Because you need both. And if not in English, need to be translated to English by a translator.

If they asking for your proof, the USC petitioner/sponsor, then just provide it. Not sure why they need proof again, since you proved it with the I-129F petition, but just send what they are asking. What did you use to prove you were a USC with the I-129F petition? Provide that again.

I am not sure why you are having so much trouble filing the AOS for the K-2.

Hello... Thank you for your help. No his natural mother is not a u.s citizen.. I'm the petitioner for both son and dad the child is my stepson...therefor I'am assuming they want my u.s citizen proof and the child's?

Well then, it looks like they are looking for evidence that YOU are a US Citizen. I would submit your US birth certificate. If you were not born in the US (and became a naturalized citizen), then you will need a statement from a U.S. consular officer stating that you are a US Citizen based on you having a valid US Passport or certificate of naturalization, or certificate of citizenship. Or CBRA.(Birth Abroad of US Citizen).

Your paragraph was written (or copied) kind of jumbled and without the proper punctuation so it was difficult to see exactly what the paragraph was saying.

But it looks like they either need proof of your US Citizenship.

A K-2 does not require an I-130. I am not sure why you filed an I-130 for the K-2. That is why they wanted your proof of citizenship, it is required for an I-130, but the K-2 is eligible to AOS based on the approved I-129F and marriage of the K-1 parent within 90 days of their entry. The K-2 is a derivative visa of the K-1. They did not require another separate I-130 petition on their behalf. They are eligible to AOS same as the K-1 parent. You went about this in a round about, more expensive way, filing as a USC stepparent instead of the USC petitioner/sponsor of the K-1 and K-2 entrants.

Since you already filed the I-130, it is now based on that. Did you not file the I-485 at the same time? You should have.
