hey Guys

i am filling a AOS for my husband . He came to the united states with a B2 visa in 2002 inspected but overstayed, My husband qualified for daca and he's currently working under daca since 2013.

we filled out all the AOS required forms but we go stuck with the I-864 form. My husband has been working and filling taxes since 2013 we have 2 kids. In total, we have (4) household size which is $30,375 requirement according to the 2016 HHS poverty Guidelines . my husband made 40k plus last year and i made roughly 30 plus.

i want to know who should fill out the I-864 form my husand or i ? how do we go around it.

Also, my husband ead expires in Aug 2017, does it need to apply for a i-765? with is package we are trying to send out our package by the end of this month.

You, as the petitioner, must fill out the I-864. Since your husband is working legally, your husband's income can be counted in your household income, which will make your household income way more than enough to satisfy the requirements. Although household members normally need to fill out an I-864A, your husband does not have to fill out an I-864A because he is the intending immigrant.

It is free to apply for EAD (with I-765) and Advance Parole (with I-131) with AOS. There is no reason not to apply for it. There is no downside.

Household members are under the age of 18. also, my husband Ead that he got from DAca expires in July 2017.. will there be any conflict if he apply again under AOS been that his current Ead is yet to expire .

quick question..

Do we have to include out medical exam result with our Aos package or just wait for the REF.. ?

Also , i need help with my Affidavit of support.. i made more money than my wife last year and shes the petitioner, we never filled joint taxes what other form do i need to fill out ? she filled out the I-864 as my sponsor .. do i have to fill out the I864a so we can meet the poverty requirements .. or do i need to fill out another I-864,,pls help
