I haven't said we wanted to lie, i wanted to hold back information that could possibly deny her B2 and someone has been kind to point out it is fraudulent with immigration, that is noted.

Sir HFM, people have difficulty getting visas to USA, UK, France, Australia and Nigeria too if they don't meet the requirements or are fraudulent about it.

and NO, I don't believe lying is OK.

about her bills, i have that figured out already, i have more than that amount to take care of her bills,travels, tests etc, just not the $100,000 mentioned up there.

Holding back information is lying....Holding back information to fit your needs and have your child born on US soil is lying. My daughters birth was $128,000 that is not including after medical costs. That was just for the time in the hospital. Your best bet is to just be honest at least if she is denied, if you apply again you can't get caught in a lie because no one ever remembers all the information they didn't or did tell. It is hard for anyone to get a visa to the US unless your country is on the VWP. It is like that for a reason, because some countries have a high risk of people overstaying.

Forget the B2 to deliver in the US. You are setting yourself up for a big fail and potential misrepresentation which carries a lifelong ban for her.

The CO will not approve her for a B2 being pregnant and with a recent money dump in her account, no way. Money from what job ? Don't be naive.

You chose the order of events the way they are, now deal with it the right way without circumventing the obvious.

No, she won't be able to visit you with a B2 once you file a spousal visa for her in the future.

You will be the one visiting her for a few years.

There are always people trying to be so smart to circumvent immigration law and they end up with disastrous visa journeys and they only

have themselves to blame.

There are no short cuts. CO's have seen it all and heard it all, your story is no different.

No one will believe she doesn't know that you have a pending case.

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

now i see.

Anyways, these comments have been extremely helpful and will surely guide our decisions.

We may finally ditch the idea of birthing in the US to avoid future complications

For the records, I am not a lawyer or john smith, that is just an example.

and No, she had no idea i have a pending petition, My reason for holding such information from her is If she knows, she may as well just decide she wont put her eggs in 1 basket

because those who get immigrant visa are generally known to ditch their former relationships after travelling. I dont want her to think that of me.

Even when i get it, i may just tell her it is for non-immigrant so as to keep her mind at ease, i want it that way.

I feel right now like i have been living in a different world entirely.

look at this case study, if i apply for a job

and i know the company frowns at facebook usage and will actually give preference to hire those who dont have a facebook account

and the interviewer asks his questions but forgets to ask about that, after the interview, which i the right thing to do

tell him, "hey, i want you to know i have a facebook account"

walk away and hold that information

My believe is

1. if they ask for the passport number of the supposed dad and she gives a wrong one, is fraud (i dont know if they ask for this)

2. if they ask the name of the dad and she mentions another, it is fraud

3. if they ask if she has a relative in US or intending immigrant and she say no (lets say i have told her) is fraud

4. if they ask her if she has any info she thinks the embassy should know, and she knows i have a pending case and she doesn't talk, this is fraud (just learnt this on this thread).

But if she is not asked 3 & 4 and she keeps quiet (is this fraud as well?)

Stop trying to beat the system. It's cases like this that make it so difficult for us to be with our loved ones! 3 world be Fraud on your part and that's a shame that your trust in her is that weak you can't tell her the truth.

4 would be fraud without a doubt.

These men and women are not stupid who work in the embassies. isn't it just better to be honest from the start so that "clean record" you spoke of can actually be clean? Nothing is more aggravating than reading posts by people who want to beat the system. In return with so many lies the process only gets harder for people honestly and legally trying to be with their families.

An F1 visa IS a NON IMMIGRANT visa...

yes, there are two types of F1 visas

F1 student visa which is a non immigrant visa

category F1 visa, immigrant visa, unmarried child of a USC over 21, and he will get his visa and come as a GC holder

the most honest one to do if you don't want to be separated from child and fiancé, is to marry and change category to F3, even If you don't like it, you will all come together

if not you will come alone, have to return to your country and marry and file for her, it can take up to 2 years and you will have to file for them both

if you keep trying to lie, it will end very badly as other have already pointed out

It is troubling that the Administrators allow 'themagician' to be seeking opinion on how to commit immigration fraud on the United States with shameless boldness and impunity. This guy's attitude characterizes the political elite of Nigeria (where I happen to come from) and which character has precipitated the country in political armagedon and economic dungeon: no electricity ; no gas; no water etc.

Administrators, please close this tread and/or ban this guy now!

while some lies made during an interview might not rise to the level of outright fraud, what they will do is undermine the applicant's credibility - and quickly! Then, when it's time for the IV interview, it could be a struggle as nothing she will say will be believed....she may prevail eventually, but it won't be quick.

As for a CO not asking certain questions, that's a laugh....first time B2 applicants get a few well chosen questions tossed at them, to 'test the waters'...then, depending on how those questions were answered, others may be fired at them that close the loop (or the noose!) around them. The more skilled the interviewer, the faster they will discern the baloney. Inconsistencies are the main killer...the vast majority of B2 applicants who try to lie their way through an interview (or who try to evade or avoid certain questions/answers) will find it challenging to keep up...their stories just don't have enough solid background in them....and once a weakness is perceived by the interview, they keep poking away at the inconsistencies, until finally the applicant runs out of lies that make sense...then, usually, silence follows the 'killer question' and that's the effective end of the interview...It's like attacking a house of cards (playing cards)...start pulling on one or two and suddenly it caves in...good COs are persistent (and fast)..attacking that house of cards constantly, to make the applicant abandon their memorized script and start answering without their scripted answers....and that's when the house of cards collapses....often, it does not take long...your fiancé would fold up like a cheap tent trying to manage the bogus answers to even normal questions...I could do her interview in less than 90 seconds and likely come up with the actual true story...(or something close to it)....the money in the bank would be the red flag....someone put it there....who? why? when? those three questions would be fired at her at a machine gun-like pace....then repeated in a different order, then I would switch back to something else, then suddenly return again to this topic....it would be over before she knew what hit her. The entire picture makes no sense from the start....and I would merely unravel it.
