'hold back information" = lying....if asked who is the father, will she stutter and give some phony answer? Who is she going to visit, will be asked of her....'oh, a cousin...'....and on and on and on it goes.....take a good close look at yourself in the mirror and when you try to couch lying in other quaint terms, all you are doing is trying to fool yourself and a CO...and COs working in Nigeria have had hours of preparation before setting foot in that country regarding the constant barrage of lies and half truths that seem to be the norm....(or 'holding back information'....gee, I've never heard that one before)....but not to worry....I have a former colleague working in Nigeria even as we speak.....guess I'll send him the above postings and let him decide.....since I prefer not to 'hold back information..'

By saying holding back information, I meant not being forward by saying, "hey, i think you should know that the father of this unborn kid has a pending immigrant petition"

FYI i haven't even told her i have a petition so how will she know, or is that lying too relationship-wise?

OP, you've yet to answer a big question here: what happens to the child and the mother after the birth?

They both will come back to Nigeria as i am not willing to risk her getting a ban, when i get the visa, i will travel, get GC, come back for marriage, then file for her under F2A as the child will be a USC already.

why live illegally when she can just come back and get filed for properly?

this is our original intention.

Since the sudden cash surge in her account will give issues, i can as well let her have it here then file for both of them, still the same just that my first child may not run for US president in future lol.

i am sure HFM will be glad to hear that.

Be prepared for it to take two years, possibly longer. That's a long time to be apart from your child.

That is funny, since you don't want to tell her that you have petition pending to become LPR, how would she answer the complying reasons to come back home after birth?

The CO will probably think she is going for birth tourism, plus the big deposit in her bank account is dubious.

I am no expert, but I will try to find a solution for you here. Hopefully one of the pros will be able to prob my way of thinking.

Just forget the birth in the US. Let's get that out of the way.

  1. You apply as a single guy (that you are and will be for some time), list your baby on DS-260.
  2. Enter the US and get the green card.
  3. Go back to Nigeria and marry the mother of your child.
  4. File for your wife and child.

It is not the easiest route and you are bound to be separated, but I think that is a good and legal way to do things.

Now I see, you thought of this before. The only difference is that I suggested that you forget the birth in US.

thats one of the reasons i want her travel ahead before she becomes an intending immigrant.

US embassy here i believe faces a lot of challenges screening those travelling with good intentions from bad intentions

so if you manage to get a B2 and you dont overstay, you seem to earn some trust at your next interview

when she eventually becomes an intending immigrant, i want to believe(i may be wrong though) her clean record will help her get B2 to visit me periodically

you realize the HFM is a retired consulate officer, correct? You have no idea whom you are dealing with and coming here and admitting you will commit fraud is just digging your own grave. But by all means...continue with your scam then come back and tell us how it goes.

I was called to the Nigerian Bar in 1995. I must say confessedly that I'm highly embarrassed that a lawyer, if 'themagician' is one, or, someone who works in a law firm, as he claims, will come before the world and be obstinately and defiantly planning how to perpetrate immigration fraud because of the terrible mentality that our people have these days that a child must be born in the United States.

Whereas Nelson Mandela was born in a village in South Africa but, became a great man; Aliko Dangote and Folorunsho Alakija( who spent about 8 years in the United States as an adult before she went back to Nigeria) were born in Nigeria but today, they are tremendously successful business people. You may google these two individuals.

Paradoxically, the like of 'themagician' would say some people were crude & cruel for 'forcing' his 'people' down to the New World some three centuries ago. What a people!

It is awfully disappointing that the Administrators have not closed this disastrous thread and or ban 'themagician.

And what if the amount of time she is given in the US is not sufficient for the birth and obtaining a US passport? Assuming she is granted a tourist visa and granted entry there is no guarantee as to how long of a visit she will be granted. It might be six months, it might be two weeks. What if she goes into labor two days prior to giving birth? Is she willing to leave the baby behind to avoid an overstay? What if she doesn't have the baby's passport before her I-94 expires. Will she overstay or will she leave the child behind? There are a lot of ifs and potential complications to your plan beyond the getting of a tourist visa.
