I have an approved i130 F1 category, my fiancee about to have a child for me

Hello all,

Please i have a pending F1 category, approved i130 petition and will likely be current this year or next.

i am planning to not let the visa officer know i have a fiancee who is about having a child for me so as to not ruin my chances if it can be ruined on that ground

However, i want to sponsor her child birth in USA.

1. Is it possible i come forward as the father of the kid who wants to sponsor the childbirth and all expenses even though i am not married to her.

the only reason i am not married to her is to avoid changing to F3 category.

2. Is it OK to use words like, I dont want to marry her yet to avoid changing from faster F1 to F3, is that in any way playing on the system?

3. could this action, i.e coming forward raise question about whether i have even married her. I have been waiting for 8 years already and the last thing i want is mess it all up.

No, it doesn't "ruin" anything. You are not married, and therefore, you are in F1 category. It's that simple. Having a fiance or not is irrelevant. You will need to list the child in the list of children on forms you fill out after the child is born. The child can immigrate as your derivative beneficiary.

There is no such thing as "sponsoring a childbirth".

i am currently in Nigeria and health care here is zero,

people die here easily during delivery and i am not happy to put her at such risk

I want her to have the child in the USA since that will be our final destination anyways.

The major issue is i want to come through as the father of the unborn child so i am planning to logde cash into her account for the purpose of the B2 visa trip

i am actually worried that she may be denied based on the sudden 3 million naira in her account, a zero balance account that has not been transacting before the interview.

what is your take on this?

You should be more worried about her being denied for misrepresentation and get a lifetime ban or something so you guys never can get together.

She will be asked for relative or family in US and it's really not a good idea to lie to immigration at all.

You should be more worried about her being denied for misrepresentation and get a lifetime ban or something so you guys never can get together.

but at the point of her applying for her B2 visa, they may not know i have a pending immigrant petition i believe (except they ask somewhere on the b2 application)

So what will she answer when the CO asks her why she wants to give birth in US, instead of staying home like millions of women do?

Does she even have job, strong home ties to qualify for B2 visa?

Deposit large amount of money in a short period of time to pad up the bank account is viewed as dubious by the CO, especially if her job doesn't seems to generate that kind of money.

at less than 1 year old, shouldn't that make her mother a derivative beneficiary of a derivative beneficiary?

lets say we decide she delivers here

if visa comes before child delivery (her EDD and date my F1 will likely be current are very close, possibly same month ), is it possible to get the baby a visa as derivative beneficiary since by that time, i will still be in the country yet to approach POE guys

or is it possible to shift interview date forward and notify embassy about the new baby.

$5k may cover the doctor's fees alone, not likely the hospital, medications etc. Average delivery is about $8k. For c section about $20k.

No, she cannot be your f1 derivatives as an f1 requires you to be single and LPR's cannot bring fiancés.

So are she and the baby going to go home after the birth?

And did that doctor fee also include the hospital fee and potential lab fees....in a trip to the hospital often doctors are billed separate from the facility and also separate from any lab work-hence the cost could be much higher. Also, these costs I assume are for a normal delivery-what if there are complications and she ends up having a C section then the costs are much higher. This also does not take into account her having a long flight when heavily pregnant as well as a flight back with a newborn. Who is going to help her out when she is in the US-your visa may not yet have been approved?

No one on this site is going to help you figure out which lie she should tell, or how to explain a sudden bank deposit, etc.....I guess you have so little respect for our laws (of the US of A) that you are willing to do anything to avoid telling the truth....and people wonder why so many people from certain countries (especially Nigeria) have such difficulties getting visas from the United States.....or do you just believe that lying is OK?

I haven't said we wanted to lie, i wanted to hold back information that could possibly deny her B2 and someone has been kind to point out it is fraudulent with immigration, that is noted.

Sir HFM, people have difficulty getting visas to USA, UK, France, Australia and Nigeria too if they don't meet the requirements or are fraudulent about it.

and NO, I don't believe lying is OK.

about her bills, i have that figured out already, i have more than that amount to take care of her bills,travels, tests etc, just not the $100,000 mentioned up there.
