Hey friends! Quick responses will be greatly appreciated!

I just started working a full-time job and only have one check stub and my fiancé's interview is approaching before my next payday. I do make enough to support both of us. I also have no tax history since I was a full-time student for a number of years and did not work. So my question is: Am I only needing a co-sponsor for their tax history? I have my own apartment with proof I pay for it and my own car. The co-sponsor will not be providing any support to me or my fiancé.

Thanks in advance! Peace and light. :)

Is your interview in 2 days??? I would say yes you'll need a co-sponsor.

Yes it is! I am excited and nervous at the same time! ok, got it. We have one, I was just wondering how necessary it was with me having a job and all. Thank you again for the quick response!

You will need a co sponsor. Because you need to show a stable income , they usually ask for 3 to 4 yrs tax transcript. So you need a co sponsor and their past 3yrs tax transcript.

In the eyes of the law, the co sponsor form in a binding contract between the government and the sponsor. So whether you will never actually use it , is up to you and the co sponsor.

Unless things have recently changed I only needed the previous year's transcript. While not needed, I also included a few check stubs and a letter of employment verification from my employer.

Unless things have recently changed I only needed the previous year's transcript. While not needed, I also included a few check stubs and a letter of employment verification from my employer.

During our 1st interview, I submitted all of that but because I had recently started making more than the poverty guidelines requirement for 2, coming out of college. The CO requested for a co sponsor and tax transcript for the past 3 yrs. She noted the 3 yrs on the form.

Needless to say, the CO didn't look at requested documents and denied our application based on something else. I underestimated the process and naively submitted the minimum documentations and we are starting all over again.

It is up to CO's discretion. I heard of a guy who attended interview with his fiance. Out of the blue, CO ask for W-2 form. Luckily, the guy had his in his pocket.

I will say, none of these documents cost money to acquire. OP should get them , if they are needed then , it's all good but if not, you have nothing to lose.

Since when did this change?

From my experience. CO noted on our form for 2nd interview to bring a co sponsor and 3 yrs of tax transcript.

We submitted 4 yrs but CO didn't look at the papers.

I'd get a co-sponsor ASAP. If you don't then the visa will be denied at the interview and you'll be put into AP until you can provide the additional information. They will either give you a second interview date or just allow you to bring the additional paperwork. You also need to submit tax transcripts for AOS showing that you meet the income requirements. You may also need a co-sponsor for AOS as well because tax transcripts aren't generated until January or February for the previous tax year. If your fiance arrives before the end of the year you'll more than likely file for AOS before the transcripts are available. From what I've read on VJ the I-134 isn't legally binding but the I-864 is.

Item Numbers 18.a. - 20. Federal Income Tax Return Information You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

So it is fair game for CO to request that. And in our case, CO did.

Ummmm yeah lol definitely left up to the discretion of the CO. I laugh because we were given a second interview because the CO requested specific information (Facebook chats) and according to my husband she didn't even look at it or any of the information that I packed into a well organized binder when he went back. Nevertheless he was granted the visa.

The I-864 is for AOS I-134 is for K-1. I-134 is submitted at the time of the K-1 interview.
