wife wants to use my last name (split topic)

My wife uses her first name, her last as a middle, and my last. It was her choice. NO issues across the board, as well as international travel.

How did you do this? Was it done legally? Was it done after she was in the states? I'm asking because my wife wants to use her Chinese first name , her last as middle and my last as her last name . we were married in China. I started the I-30 already.... Any suggestions? Like to hear what others with Chinese spouses have done.

If your wife wants to use your last name as her legal name, then these are the options:

• Get it legally changed in China and obtain a new passport with the new name (likely a very arduous task and may not be even possible)
• Have it done after entry to the US.

If doing it in the US, she will first have to go to the local court where you live that has jurisdiction on that matter. Furthermore, the fee to obtain a new green card with the new name is $450. If you have to go through the Removing Conditions on Residency process (ROC), then I would suggest timing the name change to occur closer to the time that ROC would have to be filed for. As part of the ROC package, you would submit a copy of the name change document and once that process was complete, the 10 year green card would be issued with the new name. If she decides to be a US Citizen, then she will have to opportunity to change her name during that process.

I thought I read somewhere at point of entry you could change you name at POE interview? Do they ask you then what name you want on green card?

Visa will be issued to match the exact name in the passport; green card will be issued to match the exact name on the visa. The applicant will not be asked what name they want on the green card and name changes are not done at a POE. Whatever you may have read is either outdated or grossly inaccurate.
