My husband is an American. We received Notice of Action letter(i797)one month ago. Yesterday, my husband(American citizen) got an email from USICS office that he should go to have an in-person interview in 3 days. Anybody knows what happened? Is it normal?

hi

did he send the i130? if so, did he send enough evidence of bona fide marriage? Once in a while I have seen that immigration requests in interview to show proof of bona fide marriage. now have your received the letter in the mail? because at least he should know what it is about and be prepared

Could be due to a variety of reasons.

Yes, after getting the NOA1 the USC can be called into a local USCIS office for an interview. It's not common, but it happens for a variety of reasons.

Thanks for your reply. He did send I130 with some of our wedding pictures. My husband just got an email to ask him to have an interview in 3 days, then nothing else. Maybe USICS thinks our marriage is fake?

Thanks for replying. Do you know what those reasons are? Is it possible that USICS reject our case in that interview?

If you want help then you need to put out the details about what visa and country and so on..... And please fill in your timeline.

Sorry about my incomplete information. In 2014, I was refused to enter USA at Chicago airport. My visa was canceled, and the officer told me I can withdraw application for admission. I was sent back to my country then. My husband and I got married in China last year. He went back to US and sent I130 in Feburary, 2016. On March, 3th, he received NOA1. Yesterday, he got an email from local USICS office that he was requested to have an interview. I am worried they will reject my case because I have some bad record...

hi

no, the i130 is about proving relationship to the petitioner, in your case you had to send proof with the i130 that your marriage is a real, bona fide marriage

sometimes if proof isn't enough, they request an interview. he needs to take all the proof of your marriage being real and he will be asked questions about your marriage

your tourist visa denial doesn't affect the petition

He should have atleast sent a copy of the marriage certificate. Photos arnt really evidence. Anyone can take a bunch of photos.

Normally they would send you a request for missing evidence. Never heard of anyone being called in for an interview at this stage.

Thanks for your reply. Yes, he sent the copy of our marriage certificate and my original birth and marriage certificate. I haven't heard of anyone being asked to have an interview either, that's why I am worried.

hi

Don't worry, I have, that's why I said sometimes, more than once I've heard about this, and all the times have been to show bona fide relationship so the i130 can be approved

there might be other reasons, but that's the most common one, so have him be prepared and take all evidence that he has and be prepared to answer questions about your marriage

Marriage evidence generally, or some questions related to the petitioner. It's not about the beneficiary specifically, it's about the petitioner or marriage evidence generally.

I've seen quite a few of them on here. Generally you get a decision quickly after the USCIS local office interview.

It's not normal, and usually only done when USCIS suspects a problem with your case.

This could be AWA issues; lack of bona fide marriage details; or some other kind of problem.
