Question Regarding POE and I-129f Expiration

Hi folks! I seem to remember reading something about the I-129f expiration date having something to do with the POE.

I may have read about at least a couple of cases where the applicant was denied entry despite having a valid visa because their I-129f had already expired. Could anybody shed light on this? I already have my passport and visa packet, but I wasn't planning on leaving until late July.

I-129F is a petition for a K1 visa.

The visa has an expiration date on it. You must enter the US prior to that date.

You have 90 days after entering the US to be married.

Yeah I have read about that too, I printed the email from USEM confirming the extension of my NOA 2 expiration date. My flight is on June 1st so I hope that will not be a problem. my NOA 2 expired last Jan.1.

Hi! Yes they do but don't wait for it. It will come abut 2 months after NOA2.

You can now proceed to gather all the docs in preparation for Medical and interview. Are you applying K1 from the Philippines?

Yes, I'm applying K1 from the Philippines! When I collected all the necessary documents needed for medical and interview, is it good to go schedule for an appointment? I heard slec ask confirmation letter. Thank you for answering!

I called the USEM about this issue a few hours ago. Our I-129f/NOA2 expired in February and just got my visa last week, leaving in May. USEM said it's fine and that they usually renew petitions every 4 months for one year. If you want to be sure you can email USEM so you can have a document in hand to present to POE. That's what I'm doing now. Good luck! :)

Oh okay! NOA2! Thanks thanks! Will call the Embassy to check if mine has been extended since it expired last March 24, 4 days before I had my interview!

I called the USEM about this issue a few hours ago. Our I-129f/NOA2 expired in February and just got my visa last week, leaving in May. Hi again! I just got off a call with the USEM with a quite unhelpful, pretty rude woman. Firstly, she didn't know what I was referring to when I asked about the NOA2's expiration date. She also insisted that at the POE, all I needed were a valid visa and medical report; that it didn't matter that my NOA2 had already has already expired. I explained to her that I've done a lot of research and have read of cases wherein the applicant was denied entry despite having a valid visa because of an expired NOA2. I also told her that I've read of other applicants who had there NOA2's validity extended by the USEM either automatically or upon request. She told me they had nothing to do with it and that I should call the USCIS if I wanted an extension.

She treated me like I was being an idiot and started to get exasperated with me, so I ended the call and here I am!

My Petition Expired – Can It Be Extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.

Based on this bit of information, my NOA2's validity should have automatically been extended, yes? Since my NOA2 expired on 3/24 and had my interview on 3/28. But I want to be sure.
