Husband and I aren't going to be living together -CR1

We are applying for CR1. Case is at nvc, waiting for case complete status. As we wait for our case to be completed, I (Indian national) have been accepted at a graduate school 5 hours away from my husband (USC). Do you think this could change anything for us at the interview, the fact that we are not going to be living together full time, under the same roof for the next 3-4 years? Both places are well connected by road and train and we also plan to buy a car after I move there to make traveling on weekends to see each other, easier. Thanks

Yes, I think it will be a problem. And even if you somehow get approved at the interview, there is no way the ROC will be approved. For ROC you have to live together, unless you meet the "involuntary separation" rule. One spouse choosing to study in one town and the other spouse choosing to live in another town is not considered involuntary separation.

I don't understand it, why would you apply for school in another town without discussing it and making arrangements with your spouse? If this school is the only one you can attend and you agreed as a couple that you should attend school, then why wouldn't your spouse move there with you?

ROC has been approved in similar situations before. Spouse can't always move (i.e. kids from previous relationship, employment, other school to attend). Traveled away from my spouse (so slept away more than half of the year) for my first years in the USA, before and during ROC. Still had plenty of proof of bona fide marriage, co-mingling of finances and what not. Marriage still going strong to this day...

Not every couple checks all the boxes. If you're attending grad school it is an understandable scenario. You should understand that for the removal of conditions you will need to supply evidence that you are living your lives as a married couple. Comingling of finances, travel together, time together with family and friends are things that are easy to document.
