Hello there,

I am trying to respond to a checklist request from NVC and was hoping someone can guide me to make sure i submit correct i864.

My Father (petitioner) is submitting affidavit of support for my brother and his derivatives (wife and 3 kids) but his income is only 26k so I am the joint sponsor.

According to checklist we got, my father's affidavit needs to list everyone:

[x] In Part 3. Information on the Immigrant(s) You are sponsoring, please correct the following...

[x] Items 3.a. through 27. You must list any spouse or children the principal applicant said would accompany him or her to the United States on the Immigrant Visa Application.

I have following questions for my father's affidavit of support form(questions from form are in red):

1. Should this be checked? Part 3, #2 - I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2.

2. Should #28 be 1 or 5? (principal application, wife, and 3 kids) : Enter the total number of immigrants you are sponsoring on this affidavit form Item Numbers 1.a. -27? <<< since my father's income is below the poverty guideline, the wife and 3 kids are on my joint affidavit of support >>>

questions for my joint affidavit of support:

1. Should part 3, #1 be yes or no? I am sponsoring the principal immigrant named in Part 2. <I am thinking this should be no since my father is sponsoring the principal applicant and i am sponsoring the wife and 3 kids but no seems to be for second joint sponsor which i am not.>

2. Should #28 be 4 or 5? (principal application, wife, and 3 kids) : Enter the total number of immigrants you are sponsoring on this affidavit form Item Numbers 1.a. -27? <<< since my father is covering the principal applicant, should he be counted here again? >>>

Thank you very much for your all your help. All ways appreciate it. I have contacted few attorneys and most of them want around $1200 just to look at the forms which i think is not worth it at this point since i have already done all the work.

nope, the petitioner needs to list on his i864 all those that he is petitioning for, even if his income doesn't cover it, so yes, he has to complete section 3 and write down spouse and kids who are your brothers derivatives coming with him

yes he is sponsoring your brother so that question is always yes for the petitioner, your dad is sponsoring your brother who is the beneficiary

as said he is filing for all of them, so all 4 of them must be added on his i864

nope, the petitioner needs to list on his i864 all those that he is petitioning for, even if his income doesn't cover it, so yes, he has to complete section 3 and write down spouse and kids who are your brothers derivatives coming with him

yes he is sponsoring your brother so that question is always yes for the petitioner, your dad is sponsoring your brother who is the beneficiary

as said he is filing for all of them, so all 4 of them must be added on his i864

For my father's affidavit, it is now cleared that following questions should be answered:

- Part 3, #2 - I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant named in Part 2 Should be checked.

- Enter the total number of immigrants you are sponsoring on this affidavit form Item Numbers 1.a. -27? This should be 5 <applicant, wife, and 3 kids>

Im still confused on how these should be handled on the joint affidavit of support i am submitting. How should these questions be answered?

- I am sponsoring the principal immigrant named in Part 2.

- Enter the total number of immigrants you are sponsoring on this affidavit form Item Numbers 1.a. -27? Should this be 4 (wife and 3 kids) or 5 (applicant, wife, and 3 kids)?

I believe i should answer I am sponsoring the principal immigrant named in Part 2. as NO and than answer total number of immigrants you are sponsoring on this affidavit as 4. Is this correct?

Sorry for all this. I just want to make sure we don't get another checklist. If this is complicated, should i go ahead and have an attorney take over?

the applicant would be his wife, and then on part 3 would be her 3 children, the total sum for you would be 4

now do you have enough income to cover all of them plus yourself and any other dependents that you have, if any?

Aleful, thank you very much. you have no clue how much your assistance means to me!

You have answered everything for me.

Total for my affidavit of support would be 6. Myself, my wife, my sister-in-law and 3 kids.

I make 120,000 and my wife makes 110,000. I am the only one filing i864 but we wife taxes together so our combined income is 230k. You think this would generate another checklist? Does my wife need to file i864A?
