Hiya again Misuzu and Kikat,

Sorry for the delayed in reply. As mentioned by kikat, I am from India.

Did you guys filed for i751 after getting final divorce? I consulted and hired immigration attorney before proceeding further in my case and he strongly advised me to get rid off divorce process ASAP(approved divorce by judge with mutual consent in Dec'15) to avoid unnecessary issues before filing for i751 in April/May'16.

Hi Ami,

I filed it when I got the judgement signed by the clerk (In California's family law, there is a six month of waiting period before divorce is finalized) right before I submitted my I-751 even though the my divorce was finalized in beginning of August. My attorney told me that as long as I have the judgement, I'm good to go. At that time when I filed for I-751, I checked both divorce waiver and cruelty boxes in case you are curious. I was told to process the divorce ASAP too.

I got a mail asking for more evidence. Did anybody else get that?

Hi Petrichor,

I don't think anyone else has reported getting RFE for now. This is not necessarily a bad thing although you have to handle your response to them carefully. RFE actually shows that your case file is making its way through the lines. Can you please tell us exactly what the RFE says? Thanks

If they are asking you for further evidence can you let us know what you sent we may be able to help see what you may have missed - or at least give you some idea of what to send to satisfy your RFE.

@kikat, Misuzu :- Thanks for sharing info. I also checked on "divorce waiver" since I was lacking of strong evidences to prove it. I have seen lot of my friends/friend of friends secured GC who filed as a divorce waiver in the past. Hence, I am also optimistic that we'll get GC without any hassle - it just matter of time. Keeping fingers crossed.

I filed my application to California Service Center. I did my biometrics on 04/28/2016.

On the letter it says that my documentation is insufficient. I think I gave them everything we had. But I didn't include my husband's and mine driver's license copies for some reason. I gave them jointly filed tax returns, leasing contracts of apartments and auto insurance. Everything that had both our names on it.

My husband and I are both going to school right now. We haven't bought anything major since we got married cause we are trying to finish school first, and we don't have money to buy a house or a car. We had medical insurance on and off, mainly because we couldn't really afford it. The power and internet bill is under his name, so I was wondering if we could just add my name on them right now? My friend asked my husband to put his name on her car title cause she just moved here and didn't have driver's license so she thought if would be better to have a local on the car title. She won't mind if I add my name on it too. I just don't know if it's okay to add my name to anything at this moment. Would they be suspicious that I only put name on certain paperwork after they asked for more evidence?

So heres the example evidence they listed on the letter:

Copies of driver's license;

Copies of birth certificate for any children; (we don't have kids yet)

Copies of mortgage agreements, deeds; (we sent the leasing contracts)

Copies of credit card statements;(we have a credit card together, but it only shows his name on the statement)

Copies of loan documents such as car loans, business loans etc; (we only have student loans)

Copies of tax returns include all required schedules, statements and any attachments such as W-2 records; (we gave them the tax returns)

Copies of utility bills; (water and sewer is included in the rent, power and internet is only under his name, but we can ask to add my name on them)

Any other documentation.

Any help would be much appreciated, we are totally lost.

Do you get statements for the student loans? Do both of you get your statement sent to the same address? If so, include the statements since the time you married.

Did you send tax returns or tax transcripts? If you sent tax returns, then order the transcripts and send them this time. Transcripts are stronger evidence that copies of tax returns.

Do you have any mail that is addressed to both of you? Holiday cards? Wedding or birth announcements? Do you have any other cards (gym, library, etc.) where both of you have cards, or both of you are on a statement?

Can you do wills naming each other as beneficiary?

The most important thing for you to show USCIS is that you have been together over the past two years. So adding your name to someone else's car now is not ideal. Look back over the past two years and gather info (pictures, letters, mail) that shows you have been together.

Thank you so much! Those are good suggestions. There's a catholic charity here that does immigration, so we are gonna go check it out soon too. We are trying to get as much help as possible. I just started my first semester in nursing school, I worked so hard to get in and I really want to finish it. The mail really hit my husband and I. Now we are worried about not getting it approved, that means I can't finish school. It's gonna ruin everything we've been building since I moved here. I really hope it will work out. Fingers crossed.

Kate - throw everything you have at them. Most important is the explanation letter. Pictures of both credit cards on the same page.

And...it is VERY rare that you will be denied. What it might mean is that you will both be called in for an interview. Unless you really don't know anything about each other, or each other's family, it is RARE for a true couple to fail the interview.

Most likely, whoever reviewed your file didn't find the "usual" things a couple has. Because you are both students, and you don't have a lot of assets together, you almost got a "form letter" asking for more. Be creative. Hopefully you can find your itineraries/boarding passes for the trip to your sister's wedding.

You've mentioned student loans in your previous posts. Did you put each other as the reference? May be you can print that out as well.

Your school normally asks you for emergency contact in your student profile online. If you have each other as the emergency contacts, print that info as it may be helpful

Also, the flight tickets to show you two travel back to the country for your sister's wedding. It can be another piece of documents.

Sukie, thank you so much! Yeah, we ll definitely mail them a well written explanation letter and include as much as documentations as possible. You are right, we are kinda "abnormal" to be a married couple. That's probably why they want more evidence.

Yeah, we still have the boarding passes for the trip and wedding pictures with my whole family.

Now 6 months and 6 days since I filed by 4/4 ROC at CSC. Just checked my status and nothing has changed.

March 2016 filers are 59% completed.

Any day now I hope....

Any April 2016 filers heard anything RFE or approvals? Hang in there shouldn't be long....
