Timeline

My fiance has her interview on 9/22 and I need some advice or where I can find more information to answer my question. Once she gets the visa, she wants to give her job 30 days notice and stay with her mom for 4 weeks. Does the 90 days start for us to get married start the day she receives the visa or when she enters the United States. If she does what she plans, is there a limit as to how long she can stay in her country before she needs to fly to the US. Her mom is sick and wants to spend some time with her before she goes back to the US. Just need help figuring out the time line we have to work with. Since her mom is sick, is she limited once she comes to America and gets married to when she can go back to her country to visit or stay for a few months?

Your fiancée has 6 months to enter the US after K1 approval and when she enters the 90 days to get married start counting when she enter the US. She will need Advance Parole to be able to visit her country. Once you get married you have to request the adjustment of status - and while that process goes on she cannot leave the US. However, Advance parole can be petitioned of course for a fee and if granted she will be able to leave the US and visit her country for a specif period - parent being sick I think is one of the reasons. Only follow up question would be the adjustment of status process to get a green card, how long does that take ball park. Are we talking months like the k1 process or is it longer like years. Once she gets the green card I assume she can come and go as she pleases after that.

Hi! The AOS process can take several months anywhere from 2 months onward - after the permanent residence is granted the individual cannot be away for a year. The for I-131 can be filed along with the I-485 and the work authorization. Best of luck !

My fiancé arrived at the POE-San Francisco safely!! We have been so truly blessed to be back together again. The questions they asked at POE-San Francisco was: 1) what is the name of your petitioner? 2) When and where did we meet? and; 3) When did we start dating?; That's it! After, we got the passport stamped with the final 90 date. You all have truly been a blessing going through this journey.
