Do I have to pay the filing fee for I-765 as a (c) (9)?

Hello,

I'm new here! I just got married and I'm filing all the forms to have my green card.

I have a question about I-765, do I have the filing fee? I'm in the © (9) category and it is not a renewal of EAD. A few persons in the same situation as me told me that I don't have to pay the fee as I'm filing I-485 as the same time. But in the instructions, it says that © (9) don't have to pay only if it's a renewal, which is not my case.

What should I do?

As of 2007, there's no fee for I-765 (EAD) and I-131 (Advance Parole) WHEN filing concurrently together with I-485 and I-130. Your total filing fee is $1490 broken down as $420 for I-130 and $985 + $85 biometric fee for I-485. It's on the I-485 instructions and to make you feel any better that was my fee for adjustment of status.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

You don't have to file an I-130, or file the I-485 concurrently with the I-765 and/or I-131. The fees are waived as long as you have a pending I-485. You can file the I-765 and I-131 with the I-485 or after.

NOTE: If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765. You may file the Form I-765 with your Form I-485, or you may submit the Form I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007.

I understand your confusion. I was there. We actually sent the fee ($380) ??? and three weeks later they send us the Notice of Action with a note explaining no fee was needed and the money order..

3. After filing for AOS. If you did not file for your EAD at the same time as filing your AOS packet, you may still apply for an EAD. You will however need proof of having filed for AOS. This is typically in the form of a "notice of action" or physical receipt from the office you filed at stating that they received your AOS packet. You will file as category (c)(9), "adjustment applicant".
