AOS still pending but received EAD with no combo for AP

Hello,

we are still waiting to hear about the AOS and I leave next week for Scotland. My question is, we received his EAD today in the mail but it says on the card does not have permission to travel. A few days ago we got an approval document for both the EAD and AP that expires in one year. My question is if he were to visit me in Scotland, would he have trouble returning if his EAD is not a combination card? Why would they not send us a combination card even though AP approved?

About 1% dont get a combo card, his AP will come as a letter. He will have to take both the card and the letter with him, he should have no problems.

Ok thanks. any reason why he didn't get one? and others do?

unless you applied for a combo, then its just an EAD and travelling outside is a no-no (well, AP doesnt even guarantee reentry anyway).

Check at the bottom (right?) if theres a notation there which is usually the AP. If none, and you have a letter of approval (EAD and AP), get an Infopass and go to a USCIS Center for clarification.

What does the AP approval letter say, that is most lokely his AP

The approval letter says

"your application for employment authorization and advance parole have been approved. the form I-766, employment authorization document with I-512 endorsement, will be sent to you separately. the form I-766 with the 512 endorsement is issued to you as a matter of the USCIS discretion on the basis of your pending application for adjustment of status, Form I485"

the actual ead card says " not valid for reentry to US"

later on it says in bold:

Evidence of Advance Parole: the form I-766 with I-512 endorsement is also evidence that, while your form I-485 remains pending, you may travel abroad without abandoning your I-485.

So are we also waiting for an additional form I-512?

I applied for AOS, EAD and AP after we were married and have received approval on the EAD and AP per I797 but when the card came, it says not to be used to reenter, it is NOT a combination card as it should be. I am calling to find out WHY or if the AP will be sent separately.

That states you should receive a combo card. You can call and seeif they are sending an AP letter

I just spoke with USCIS tier 2.. they stated that they made a mistake and did not send the correct card and he put in a request to get the combo card.. SMH. he said that we should hear something by April 15th on whether he needs to send back the card he has or if they are just going to send him the right one. Thanks for your guidance as always your on point PINKRLION:) but at least he can work now. We will worry about traveling when the time comes.

Sounds like a USCIS error.

I would make an Infopass and discuss it there. Do not travel abroad until the issue is resolved.

Your letter and your card presented in combination with each other are what you use for advanced parole then. You must have those two when you renter until you get your green card.

No. When you don't have a combo AP/EAD you just use the paper AP. At that point the EAD is exactly that - just an EAD. It isn't needed at all to re-enter, and has as much importance as a library card.

They haven't received the actual AP, only the approval notice. So it would be a huge no-no to leave the country now.

 

And like Hypnos said, if they had received AP on a separate piece of paper then that's the only document they need to bring when travelling. The EAD card can stay home.
