Hi

Got married in Jan 2014. Did not get my green card until nov 2014. We are now getting divorced but it will not happen right away will be done around aug.

I did enter the marriage on good terms but it did not end like we wanted. I know she will not sign any papers together with me. We will still be married when I send it so I will write in remarks we are getting divorced. We have been married over 2 years together owned a house together and so on. I got a job I am happy with and dont really want to move. Is it really difficult to stay after you got divorced to get a 10 year greencard?

If you have decent evidence like the joint home ownership etc you should be fine.

Yes we did own it together we had a normal relationship that was for real. Her parents been visiting and mine at the same time at serveral occasion . She been visiting my parents in my home country, she cheated on me I did walk away eod from my side.

Then with good co-mingling of finances you should be fine with a divorce waiver. Have you filed for divorce yet?

No not yet right now we are not on speaking terms so will let the smoke clear a bit. We also did like together in my country over 2 years before we moved to america. Do you think I need a lawyer ? And what evidence should i gather?

I went through the divorce waiver process, but we were divorced before I filed. You should be able to do it if you have enough evidence to prove that your marriage was bona fide.

NLR answered your second question.

Regarding the lawyer, it really depends on you, but I generally recommend getting a lawyer in this situation to make sure everything is in order. That's what I did, because removing conditions with a divorce waiver is a more "critical" situtation.

Make sure you start gathering evidence now. When relationships go bad or divorce happens, you may lose access to some of that evidence.
