Another very quick questioon lol.

Our joint sponsor is married and has two children whom he claims in his tax returns. He also filed his return as Married filing jointly. his wife doesnt really make any money and the amount he makes covers for all his dependents, his wife, and my husband (the beneficiary) as well.

my question here is: are we required to submit a I-1842A for his wife? even if we are not interested in using her income (its not needed). But do we still have to do it just because they filed taxes married jointly?????????

No I-864A for wife is needed if they don't need or want to consider her income. Be sure to attach his W2 so it's clear what his income is.

And his household size will be 5. His 4 plus the immigrant.

My wife filed 1040ez form for her taxes. I heard that if you file this tax form, then you should use the adjusted gross income rather than the gross income on the I-864(affidavit of support)! She filed using her gross income showing on her w2, as well as tax transcripts. Is that correct or did we have to use some adjusted income? Also, i heard that we had to write N/A in spaces that were supposed to be blank even though the instructions say to LEAVE THEM BLANK (such as leaving the mailing adress blank if it is the same as the physical adress)

Yes it does state if you filed 1040EZ you use adjusted gross. So she filed out wrong unless her adjusted gross is her gross.

As far as N/A and NONE it depends on the adjudicator but it shouldn't be an issue.

Also, one of the dependents on the joint sponsor's tax return appears to have an minor income from a pension. this income is added to my JS income which adds the total income at the bottom. My worry here is that we really dont need this additional "pension" income to meet the requirement. My JS's W2 income is sufficient. However, I am concerned that if I put this total income in the AOS form, NVC might think im using the dependent's income and would request a I1864A.

If someone understands, please help.

You are correct he can't list that its the dependents money they would have to do a I-864A also.

ok. So what you are saying is that I now need a I-864A too :( ?? I was really hoping not. I will be including a W2 and an employment letter for my joint sponsor which will clarify what his income is. We are really not interested in including anyone else information.

Do we really have to include the information for all three most recent tax returns? I mean I understand we DO NOT need to include transcript for all three but do We really have to like manually input the information for tax years 2013 and 2014? Can't we just put in "N/A" for the sake of not leaving it blank? Im including everything for 2015, transcripts, tax return, w2.

September 17th, 2015 - NOA1 email and text received from USCIS. :)

March 11th, 2016 - Approval date ( routed to NVC) :dancing:

March 12th, 2016 - NOA2email and text received from USCIS.

March 24th, 2016 - Text n email ( Case sent to NVC for processing)

No I was saying if they are going to consider the dependents income then a I-864A. But is the dependent a minor? so they can't use. If it was money the parent gets for child that's different.

Yes you must list the lat 3 years gross income as stated on income tax. If you didn't file an explanation has to be given why you didn't file.
