Hello everyone, I would like to get some advise here, I was told during my k1 visa interview in the US embassy in Honduras that I had to pay USCIS immigration fee of $165 before traveling to the US (to receive green card), I couldn't do it then, so I'm trying to do it now that I'm already in the US, my fiance and I are getting married next week and we will start adjustment of status right after that, but I was wondering if this $165 fee is different from the adjustment of status fee I have to pay or is it the same? Thanks for your help and any other comments about the topic will be appreciated.

Hi,

The US$165 fee is for the green card. This link gives more details into what you're asking:

That $165 fee is only for people doing Consular Processing who enter the US with immigrant visas. You entered on K-1 and are doing Adjustment of Status and you don't pay that fee; whoever told you that was confused.

Newacct, thanks for your reply, I'm actually still confused, We did all the K-1 visa process and then the casr was sent to the emabassy in Honduras, so I could have the interview. After my interview I was given a paper saying that my K-1 visa vas approved and that in order for me to get a green card I had to pay the USCIS fee which is that $165 and it actually advise people to pay for it online before leaving the country, do you know of any info that I could be missing? We are sending the AOS application probably by next week, we are still translating the birth certificate and getting a certified copy of the marriage, thanks for your help.

It must be a form letter for people who get immigrant visas that they forgot to edit for K-1, and K-1 are processed by the same department as immigrant visas, so they gave the same letter to you too.

You do not get a green card upon entering the US. You do not pay that fee. You have to apply for AOS to get the green card and the AOS fee includes everything.
