RFE sent late!!!What will happen?

Hi All!

I'm very curious what will happen if you sent the AOS RFE late? I read on some papers that they will deny the application? If this happen, what can we do? As I belong to this category.. I just want to prepare my mind on what trouble im into. :P Any advice on what to do when/if denied? pleassssssse helpppp!!!!

11/08/2004 - my honey's 8th & last visit[/color].

11/09/2004 - Interview & SUCCESS!!!

11/12/2004 - Flight to SC with my honey

12/29/2004 - The big day; OUR WEDDING DAY!!!

02/03/2005 - AOS & EAD sent to TSC

03/14/2005 - EAD & AOS NOA1 received!

03/14/2005 - check cashed in

04/12/2005 - Biometrics/fingerprinting done in Charlotte, N.C.

04/20/2005 - EAD card received!!!

09/19/2005 - received email from USCIS, case transferred to CSC

12/23/2005 - Im PREGNANT!!! (don't believe right away if dr's said "u can't have a baby!")[/

02/15/2006 - received e-mail from USCIS AOS APPPROVED!!

02/21/2006 - GREEN CARD RECEIVED!!!!!!! !!!!!!!

08/11/2006 - Its a BABY GIRL!!!!!! (my honey said she's my mini me!)

12/2006 - My hubby was dx with cancer

04/2007 - The saddest day of my life... my hubby passed away at the age of 38

01/08/2008 - Removal of condition application submitted (I-751) to VSC

01/24/2008 - Checked cash in

01/26/2008 - NOA received

02/22/2008 - Biometrics appointment

03/2008 - Letter of extension received.

08/2008 - VSC still processing 09/2007 application

11/2008 - Patiently waiting..........

12/12/2008 - 10 yr. green card received!! !!!!

01/25/2010 - waiting for the time to apply for citizenship!!

What was the reason you didn't comply with the RFE?

Did you know that you can either submit what it asks for; resubmit what you already have or ask them to adjudicate on what they have already and still be considered as having responded and complied? It's just not wise to ignore an RFE as the petition can be denied. Once denied you'd have to file a Motion to Reconsider or a Motion to Reopen (if there is something which you could have supplied, but didn't). Beware: Appealing a denial is time sensitive, and of course only an option if you are adjusting from a visa basis (VWP = no appeal). If you have received a denial it's time to summons assistance from an immigration attorney.

I wasn't able to reply the RFE right away for couple reason. one thing was financial reason & 2nd is we forgot about it sicne we were busy taking care of my dying grandmother and we were looking to talk to my mother inlaw to sponsor me since my husbands salary is below poverty line this year. I know I shouldn't forget about it but it happens.

Anyway, I know its a pain on the butt to re apply or to appeal but Im hoping that they will consider my RFE. I sent it on the day of last submission, we overnight the package. So im crossing all my fingers & toes until I will hear anything from them.
