Shall I apply for B2 Tourist visa? I am a British Citizen

Timeline

I am a British citizen. My wife is Peruvian but she is into the final stages of becoming a US citizen, interview in a few weeks. Basically I have been coming in and out of USA alot in the last couple of years using the Esta Waiver programe. Immigration started to get strict with me the last couple of times and the last time told me that if I want to keep coming in and out of the country, then I should apply for the B2 visa. (which I didn't know I could apply for).

The problem is that I have been reading many horror stories about Waiver countries being rejected this visa. My wife has petitioned for me but of course I am at the bottom of the queue because she isn't a citizen yet. As soon as she becomes one that can speed up the process.

My dilemma is my last time I visit her was 2 weeks ago when i returned to the UK, and I want to visit her for a week at the end of April. I have a full-time job and a contract for my rental house in London.

Anybody any advice on what I should do? I am scared to go on an Esta again because of getting rejected at the border, and scared to apply for the B2 (even though they advised it) because of reading some of the so called horror stories on here.

Unlikely you will be able to obtain a B2, seeing as you are from a VWP country to begin with. Spend more time in your country than in the US. Stop with frequent visits at this time and wait a good while. I know it's hard, but if you want to maintain the privileges you've got, then you have to do what you have to do.

The good side of your frequent visits to America on the VWP is that you have shown that you come and leave, not stay. So all those stamps in your passport would be a good thing when applying for a B2. But as many have said, just avoid applying for it for now, and make sure you don't over use your vwp :D

Because the B2 us unlikely to be granted.

No doubt you were "spoken to" by immigration because you have been spending more time in the USA than out (or close to). The VWP is got visiting, not living in the USA in installments with little trips back to the UK every once in a while.

It's great that your work allows you to be absent so frequently but don't abuse your VWP privilege.
