Nothing. You can wait to make sure you collect evidence or file immediately to get your 10 year card and get on with your life.

Well I'm filing now after almost a year divorced so it's too late to do it right after. I didn't know if I had to file right after. I didn't know that. I thought I had to wait until GC almost ends.

Anyway thank you for your answer.

I'm in a similar situation so I've been following your case. The difference is that I didn't come on a K-1, I adjusted from an H-1 after living in the US for 8 years.

The first lawyer I consulted with said I had to wait until the 90 day window opened. I dumped that lawyer and got another one who was very helpful with gathering relevant documents.

My divorce was final last April and I should have filed immediately so that the decision would have been made already, instead I waited until December and now I'm waiting until probably October for an answer. If I had waited until the window opened I would be filing around now.

I do of course!! I didn't need to leave my country for no reason really but now it's done. As said above by someone else, we don't control what happens with the heart.

I don't know about your visa at all. What is it exactly?

Then what about the k-2 since my other child came after us? Can she file with us too even though her GC expires next year?

I would think you would be able to do both but I am not positive.
