Tax Filing - Do I need to amend? Help please.

I got married January of this year and last week filed my 2015 tax return. Since, I filled out my last year's W-4 as SINGLE and didn't get married til this year, I figured for last year's tax filing I need to file as single. But after reading the NVC process document on V.J. apparently I have 3 options while filing my taxes - married filing separately (MFS), married filing jointly (MFJ), or head of household (HOH).

So question to all of your wise folks on this forum --- Do I need to amend my taxes and file as Married filing separately? I'm expecting my wife's interview to be at the end of the year (November or December). Any advice is much appreciated.

You're fine. Your marital status on the last day of the year is your marital status for the entire year. You were single on December 31, 2015 so you file single.

I tried to file as married filing separately and the tax agent told me I can't do that unless he has a social security or a tax number with the IRS. So now I will have to amend it when he gets one of those. I'm just worried it will cause me problem's.

You were told wrong, you don't need a SSN or ITIN for Married Filing Separately.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I seen the computer program it wouldn't let him complete the tax forms with out one of them filled in. He also called a supervisor over to see if theres a way around it and they also said no. So I'm not sure. When I did research thatS all I could find is he needs his ITIN number for you to do that. So how do I than?

That's because he was trying to file online. All you have to do is complete the form but if no SSN or ITIN it has to be mailed in. Goodness they should be trained enough to know that. When you print off the form just write NRA where spouse SSN would be.

Well my husband has applied for the itin and now I will have to amend it since my taxes have been filed already for 2 years as single because of this agent.
