Hi,i have been here in US for 2 years next month,i came using k-1 visa and got married..but until now i dont have greencard because of financial problems..our marriage is not working anymore..can i petition myself?is there a big chance that i can get a greencard?there is no abuse its just not workin anymore..he wanted to send me back home but i would want to try to get greencard and stay here to find job..please help is there anyone same my situation?

nope, the only way is through your fiancé, so if things don't work out, go home

if you stay you will be undocumented, since you came on a K1, even if you found someone else, you cannot get your GC through another spouse

you must return home, that's what you signed for

I read about that on USCIS website about self petition..i think it says i can if there is abuse and if no abuse i should prove that my marriage is bonafide and i married him in good faight:(

The only way to obtain your green card is for you to still be in a marriage with the person who petitioned for you and for them to provide an affidavit of support. If you marriage is failing at the time you file you do not qualify. If he refuses to provide the affidavit of support you cannot adjust.

That is for removing conditions after you have your greencard

yes, but to get the gc you need your husband to prove that you have a bona fide marriage,

without your husband there is nothing you can do

You did not file for AOS? If that is the case you are out of status for years. K1 is only valid for 90 days, even if you got married, you are still undocumented. Talk to your husband and file AOS asap.

Jan 31 - received USCIS letter/ Notice for interview 

March 3- Interview, approved on the Spot

March 8 - received GC

Dec 2018 - To file ROC

Jan 11, 2016 - Interview- APPROVED!

Jan 15 - Visa ISSUED!

Jan 21 - VISA ON HAND! (8 working days from interview)

March 21 - CFO / PDOS for K2s

June 1, 2016 - POE

July 18, 2016 - Married

I am his and he is mine from this day until the end of my days..
