Any aos/ead/ap from b2 visa experience here? My case was received Jan. 4th, had biometrics and no rfe's. I submitted inquiry since my ead is past 75 days and it's turning 90 days on April 4th. Does it really take that, well, long? Thanks.

You are adjusting from B2- a Tourist Visa and not for immigration intent. Obviously they will scrutinize your papers more to check immigration intent when you entered using your tourist visa.

this kind of AOS make it more difficult for other to get B2 from PH.

You are adjusting from B2- a Tourist Visa and not for immigration intent. Obviously they will scrutinize your papers more to check immigration intent when you entered using your tourist visa.

this kind of AOS make it more difficult for other to get B2 from PH.

Are you seriously implying that AOS petitions for people on b/2 visas is more scrutinized than for any other visa? Have you read any of the immigration laws that state that intent for immediate family relatives cannot be considered after they have arrive ? AND your implying that it makes it more difficult for others to get visas because some one decides after they arrive on a b/2 to immigrate ? where is your evidence for such a claim?Please cite it because I can back up what I am saying. It is really unfair for people like you to comment as a "platinum" member on someones application when your obviously just trying to discourage them, because what your saying has no basis in fact or law.I didn't realize there was a hierarchy to AOS applications Unbelievable.

Because a person who arrives on a tourist visa has not already undergone the background checks nor the verification of the relationship of course it will take longer for their paper work to be completed (in general). As to making it more difficult for others from their country to obtain a visitor's visa of course it will. This is just one more statistic for that country that a tourist visa is possibly being misused.

To get even get a visa there is a multitude of checks that happen. As to your other broad assertions, unless you can site specific evidence that The United states keeps a list of people who come from specific countries and immigrate from tourist visas,and then make it harder for people from said countries to get visas, your simply making things up.Please cite your evidence for your claims. If what your saying is true there would be separate processing times listed on the uscis websites for aos based on visa issued.

Not nearly as extensive of a background check as when a visa with immigrant intent is applied for. This is one big loop hole that is the "elephant in the room" since 9/11. All the hijackers came on tourist or student visas and had very limited checks done. Same today otherwise it would take months to obtain a tourist visa. I seriously doubt every person applying for a tourist visa is run through the CIA/FBI/DHS/Interpol system. I don't see a requirement for tourist visas for a police check.

As to citing the sources I can't but common sense should tell you the US keeps track of how many tourist visas are issued each year and what country they are from/issued in.

Abusing a tourist visa to stay in the US illegally is the main reason it is more difficult to a get a tourist visa in some countries than in others. It is not someone following the immigration laws and filing to stay legally that is the problem. 'This kind of AOS' is perfectly legal, and intent alone is not a reason to deny AOS for an applicant married to a USC.

Hey, my comments is based on experiences from my country of origin and holds true. Read my comment again and don't over react!

We are taking about tourist visa here, of course you know what it was intended for. I will not encourage adjusting from tourist visa to migrate nor I will be suggesting that to anyone - that's my standpoint. Now if any one chooses to adjust from B2 i am not saying they can't; all I am saying is obviously they will pass through a more thorough adjudication since B2 is not an immigrant visa.
