Gurus Please Advise

This is a great community which I regret not using so far!

I am seeking advice from experienced gurus out there on my situation.

Here is the situation:

Boy is US citizen - naturalized and girl is from India. Engaged in December 15. We wanted to be sure and safe and hence settled for filing GC after marriage. But still 8 months are there for marriage in India.

Please advise if it is a good idea to start K1 now.

What will be the time frame - K1 approval and when girl can travel to US for marriage here?

Main goal is : to know if we will be in a better position by K1 process on the day of marriage in November last week of 2016.

If nothing happens - approval of K1 - can I retract the petition and go for filing GC sponsoring by boy (IR).

Your post is a bit confusing. If I understand this right, you want to get married in India in November 2016? If so, you cannot file for the K1, that is ONLY if you get married in the USA.

If your plan is: get married in November 2016, doesn't matter where, you can try and file the K1 now and hope it goers quickly; it may be approved by November, but you are cutting it fine. If it is not aproved by your deadline then yes, you can withdraw it, get married in India and file for the CR-1 spousal visa, but you loose all the money you spent on the K1 filing and start again at the beginning, aiting about a year from the time you file for the CR-1 spousal visa to get the interview and (hopefully) visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The K-1 is a visa for marriage between two consenting adults (18 years of age or with parents permission if less but within age requirement of the state you live in).

So the K-1 is for a adults not kids.

Please advise if it is a good idea to start K1 now.

Plan for NOA2 to take 10 months, be happy with 5. NVC then takes about one month and the Embassy usually two months. Do the math.

Main goal is : to know if we will be in a better position by K1 process on the day of marriage in November last week of 2016.

It's now the first of April. End of November is 8 months away. So usual best case is 8 months overall to 13 months overall. We see a lot of extra AP following the interview for your Embassy. So marriage end of Nov is a maybe.

No There is no petitioning for any visa or a GC between someone not related to you.

They are above 18 and hence adults.

What is AP in "We see a lot of extra AP following the interview for your Embassy."

Administrative Processing.....means additional background checks. Everyone from that section of the world undergoes additional AP. Go over to the India regional forum and do some homework on cases over there.
