You can fly at 27 weeks...

What country are you from?

Your brother still has to show strong ties to his home country

If he can't take him and you can't, can't your husband go or otherwise airlines have programs for kids flying alone..

What country are you from? How is your son traveling to the US? What ties does your brother have to his home country?

Reason to travel to the US are irrelevant (although he will be asked why he is going and if he has family in the US) the reasons he MUST return are more important.

My son is scheduled for his interview next month, I am from the Philippines. Hubby cant he needs to pass a lot of paper work to get leave. And he doesnt have much leave days right now.

your son, who will likely get his IR2 visa, cannot precede you entering the US...you have to be with him (or go first, then return).

You are the primary beneficiary.

As for your brother getting a B2 visa for this purpose, well, there is absolutely no guarantee that he would get one.....remember (as has been stated about 1733 times on this site), COs don't really care why one wants to GO to the US; they are primarily concerned with why someone would LEAVE the US after a visit.

Your brother would have to overcome the presumption of immigrant intent, all by himself, without any (ok, I am going whisper the nearly forbidden word)

letter from you attesting to his reasons for going, etc. Whatever his situation is in the PI is what he must use to convince the CO that he is a bona fide tourist, who will depart the US at the appropriate time, and not engage in unauthorized employment. Neither you nor your husband can play any positive role in this matter.

You should know that this particular ploy or excuse has been often used to bring relatives to the US from many developing countries, after which said relatives 'forget' to return.

But check on the current regulations regarding your entry to the US versus your son's first entry...I believe that on his first trip, you must either precede his entry or be admitted together.

I think the OP is in the US. Seems quite common to leave children behind in PI.

The child will have 6 months to utilise the visa so there is no great rush.

How old is the child?

I am actually in Philippines right now. Just really have to come back soon because of the screening that I need to take before we pcs to another state. Thank you for the advice! :-)

I know BA recently announced they were dropping their unaccompanied children service, but I am sure other air lines do it, much cheaper and more certain and not an issue at 9.
