The answer is way to complicated for this forum, especially with you giving no background information

on the visa pathway to those involved. Consult a good immigration attorney.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Yes you can, Guardianship is what you need to bring the child into United States legally. This process is similar to adoption and grandparents or foster parent use it. Please be advise that you will be verify by the social services in the process. Also a legal practitioner will also have to draft you 4 letters to present social services and immigration.

There is no visa for grandchildren as already stated.

The only possible path for a grandparent to petion a grandchild is legal adoption. Not to be confused with legal custody or guardianship. But legal adoption is what immigration is concerned about.

I would like to know if it's possible for grandparents to provide their grandson with US residency status. Can this be done via child custody procedures or via a child adoption? Please find our case details below.

Case:

  • Both grandparents are United States Citizens
  • Grandmother acquired citizenship through marriage of a US Citizen.
  • The child is a Russian citizen, visiting the USA on a tourist visa
  • The child's mother is presently working and living in Moscow
  • The child is 14 years old
  • The child is attending a public school while living with his grandparents in Florida.

Hi,

As already mentioned, there is no way for grandparents to petition grandchildren directly. Even if the child is in the US. The only path is for the grandparents to petition the child's parents first. And through that the child would then come via his/her parents.

In this case there could be no adoption because the child's parent is still alive.

Also, the child is not suppose to be going to school on a tourist visa. A tourist visa is only supposed to be visiting and touring. And since he is going to school let's assume he has or will overstay his/her visa. These are two major violations of the child's current visa.

The visa overystay plus the child going to school has only made things worse. There is no way the child can become a legal resident in their current situation. Best for the child to return to his/her country as they would only continue to live here illegally.
