I-864 Affidavit of Support where Mother is Home maker

hello guys,

our mother sponsored us (three sons with I-130 form) in 2010 and now our immigration process initiated in Feb, 2016. USCIS requested supporting documents which are straight forward process and are ready for courier.

now, my mother is home maker and don't have any source of income beside us (e.g. sons) though she owns a property and but she is dependent on us. whereas, we all sons are qualified, employed, and have sufficed funds to support immigration process, travel to US, and can stay there without government or relative support (we owe at least US$ 30,000) which meet or exceeds US Income Requirements and Poverty Guidelines.

Now please guide,

1) does we all sons have to fill affidavit of support individually, or

2) mother need to fill affidavit of support, or

3) in our case affidavit of support is not required

Your guidance will help to follow right path.

Mom as the petitioner must submit an affidavit of support regardless of income.

If mom can't meet the requirements then another joint sponsor (any US citizen or green card holder living in the US) must be found whose income meets the requirement for their household count plus the intending immigrant(s). There can be different joint sponsors for each son.

thanks for prompt response, actually US relatives already exhausted their limits by sponsoring other relatives in queue. so that is why need suggestion how to proceed further without going in to wrong direction.

Look at the form your mother will submit https://www.uscis.gov/sites/default/files/files/form/i-864.pdf

And read the instructions https://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

The Instructions will explain in detail what is required and you may figure something out such as

Item Numbers 6. - 9. Assets of the Intending Immigrant. You may use the assets of the intending immigrant regardless of where he or she resides. The intending immigrant must provide evidence of such assets with this affidavit. Add together Item Numbers 6. - 8. and enter the total number in Item Number 9. Form I-864A is not required to document the intending immigrants assets.

It doesn't have to be a family member

You will need a lot more than 30000 to self sponsor. You need 5 times the shortage. If you mother makes 0 than you need 5 times the poverty level. Is you mother living alone or is she married ? Are there other children already in the household ?

This will not be over quickly. You will not enjoy this.

I think he means Mom + 3 sons requires $30,000 income from Mom. Using assets instead of income could be $150,000.

Hello,

Guys, thanks a lot! actually mom is widow and dependent on sons. as per poverty guidelines, we need to have 25,200 for 3 (as per my understanding) at least to prove that we have suffice funds. ( source: www.uscis.gov/sites/default/files/files/form/i-864p.pdf .

So each son does have approx US$ 20,000 in reserve to meet requirement. now, i'm clear that there is need to file I-684, but now question arises which form is appropriate for us to show mentioned amount since considering our criteria. your suggestions are helping. now i'm considering to include property documents which she owns as cash worthy.

Just for own clarity, do we need to have amount five times of "25,200" to show suffice funds, is that correct?

Are you currently in the US on other visas so you have a job that would continue ? If not her household size is 4 ( her and 3 sons ) and if you are trying to use cash you need 5 times the poverty level is cash/assets

i'm not in USA, and someone (her brother) already supporting her (my mother) for living expenses in USA and showing in tax statements as dependent. since we (sons) are perspective immigrants and have to have suffice funds for immigration, so do we still need to include mother? need clarity.

You said there are 3 of you , assuming there is no child in the house then her household is her and the 3 of you ( she has to be able to feed herself also ) The number for the 48 states at 4 is 24,300 ( the number you stated earlier is for 3 in Alaska ) To use assets/cash you need to have 5 times that amount in liquid value.

I also think the household should be 4, but looking at the form, I can see where a household of two could come up. How would you fill this out?

Brother A, B, and C are on separate petitions, so are also on separate I-864s.

Persons NOT sponsored in this affidavit:

2. Yourself Mom the sponsor

3. If you are currently married, enter "1" for your spouse

4. If you have dependent children, enter the number here.

5. If you have any other dependents, enter the number here.

6. If you have sponsored any other persons on Form I-864 or Form I-864 EZ who are now lawful permanent residents, enter the number here.

7. OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here

8. Add together Part 5., Item Numbers 1. - 7. and enter the number here. Household Size: Two?

Taking the form literally, brothers B and C don't fit #6 because it says other persons sponsored who are now permanent residents.

The embassy will see that there are more in the system just like any family group ( same as bring a wife and 2 step children each with there own I130's )
