Once Married, can we leave the country for a Honeymoon?

My fiance is dutch, and we cant seem to find a firm answer. Once we are married and file for change of status, is he allowed to leave the country in order for us to go on a honeymoon?

we know you are allowed to file for special permission to leave the country, but we can't file for one of those until we are married, and if we are supposed to leave right away for a honeymoon, we wont have time.

My fiance is Dutch

Until has gets the AOS processed to the point the waiver to allow travel, he cannot leave or it will invalidate his AOS application.

Although you will not be able to immediately travel, you can file for Advance Parole along with his EAD card when you file your AOS papers. It may take 2-3 months, but then once you get it, you should be able to travel while your AOS is being processed.

There's lots of nice places in the US to have a honeymoon :)

You can even go to Hawaii if you are looking to be lazy on a beach all day

My husband and I are saving moolah until we are able to afford a nice getaway when all the AOS is said and done, so we skipped the "right after marriage" honeymoon.

Everyone is allowed to leave the US at any time, no special permission is needed. What is needed is a visa or something else to be able to re-enter. That is what the AP or GC is for.

Correct. You get married, file for AOS along with the EAD and AP, then wait about three months to receive the AP & EAD. Then one can leave and be able to reenter.

You can't.

Your plans are awry and need to be changed. Honeymoon in the US or later after the AP or GC is in hand. If they leave before either, then they won't be allowed back in. They would be returned to their home country. Then you would file for a CR-1 Spousal Visa and wait the year it takes to receive.

We wanted to go to the Caribbean for our honeymoon and thankfully we figured out we could only legally go to Puerto Rico or US Virgin Islands to be able to get back in. This was seven months ago.

You don't go through any immigration, only security so US Citizens don't need a passport, and you won't need your AP. No one questioned us. We did take our marriage license just in case but no one flinched.

Either that or Hawaii is the closest you'll get to leaving the mainland without AP :)

OK, I would do more research for the US territories before I get into anymore of that lol

I could be wrong. US territories are different than US states. But I believe if you have a valid I-94, you should be able to ... at least for Puerto Rico.

Apr 25 2016: Children received P4 letters in the mail

May 19 2016: Interview

Jun 03 2016: Received Visas

Jul 06 2016: Travel to US

Be careful when booking flights, if your flight goes via a Non-US territory you will have to clear the border again.

I forget where, but someone mentioned one of the US oversea's territories as being only reachable via a non US country... unsure where I read this.
