My USCIS Tracker updated to a "Document was mailed" on May 31, 2016 for all my 3 receipt I485, I131 & I765. Not sure what kind of document.

Woohoo! I just got my EAD/AP card today (its just one card)

My GC application is still on RFE response received, so no change for a while. But it doesn't really matter too much now since we can basically work and travel. Such a relief!

Our AOS Timeline (from K1)

Application posted - March 31 (overnight delivery)

Received - April 1

NOA received - April 10 (NOA date April 6)

Biometrics date - May 10

RFE received - May 23 (missing tax document for 2015)

RFE response sent - May 26

EAD Card produced - June 3

Hey I've been gone for a while, but its god to see most people progressing thru the application process. I received a RFE bc of my financial co-sponsor, but i don't understand the RFE form....it has three separate boxes with an 'x' marked in them...and under each {x} there is a list of documents that they want.

the first {x} "the joint sponsor lists the current income on form i-864 as an amount to be considered as sufficient. however no evidence has been submitted as proof of income

the second {x} "submit all suporting tax documents submitted to the IRS for the most recent tax year"

the third {x} "Based on the documents submitted with form i-864, the joint sponsor's income did not meet 125% of the poverty guideline

Im confused bc the 1st and 3rd are contradictory....i know my joint sponsor is over the 125% poverty income. do i simply ignore the third??

I got the same RFIE, except that mine also has an extra box that says to include the tax return for 2015 or explain why the joint sponsor didn't have to file.

My guess is that these are generic letters and therefore they don't make too much sense. For example, I get asked to include a 2015 tax return or explain why he didn't file. Once we explain why he wasn't required to file for a tax return, then the point about supporting tax documentations becomes invalid/unnecessary.

Also, one point says that the income on the form i-864 should be enough but the supporting evidence doesn't prove that. Therefore, if the supporting evidence wasn't enough to prove the income, it also shouldn't be enough to prove that the joint sponsor meets the 125% of the poverty guideline.

What I'm thinking is that from this letter, they meant "you didn't provide proof of enough income and this may be a mistake. if you can fix it and prove to us that the income exists and is above the 125%, then it's ok, but in case you couldn't prove the income because HE DOESN'T have enough money then you should include assets or get a different sponsor."

Also, assets are supposed to be equivalent to 3x the shortage, so they need to be worth a specific amount, and if our joint sponsor is above the poverty guidelines, then what shortage should it compensate for? In any case, this is what I am HOPING it means, because I'm on the same boat and our joint sponsor doesn't have assets to include really, or we wouldn't know if they would be worth enough to cover a nonexisting shortage.

Because at the beginning of the letter they say that you basically get one chance to get it right or will be denied, we are scared to send the evidence without including assets, and that's why we went to an infopass, to get some assurance. The woman though didn't really know much, she barely understood the RFIE (had to make her read it a couple times again so she would understand) and told us to just "go above and beyond and include assets", which left us nowhere, because she wasn't really sure of anything. I talked to a USCIS person on the phone too and they seemed to think that if we prove he makes sufficient income, then we won't need assets, but he wasn't sure so he directed me to a mythical tier 2. Sadly I never got a call back, so I'll try again tomorrow.

If you figure it out or have any better explanation or assurance from USCIS, i would very much appreciate it if you let me know, because we are pretty nervous too. Good luck!!

Awesome!! So we're in the same situation now -- also waiting for RFE response!! It is a relief! I just hope people will know they can hire me on that card! I'm not sure if it's very common to work on EAD.

Finally caved and called the USCIS. I didn't get any new info on either of my applications but a service request was put in for my EAD as it has been more than 75 days. According to the officer I should hear back within 15 days, hopefully he's right. In regards to my GC I can't put in a service request until July 17 based off of the dates on my case.

I'm so happy I used delivery confirmation on the RFE response because I know it has been delivered however I just wanted to make sure my case is not sitting in some pile which I also made him aware of lol

So I don't really know more than I did 30 minutes ago but at least now I know they'll look into my EAD application :)

Very often when the interview for the GC is scheduled so fast, the EAD and AP are bypassed since you'll have the GC soon :)

If you want to see a more detailed information about people filling out the same office as you in a easy to read data base you can go to the top of the pae select "immigration timelines" then scroll down and click "AOS timelines" then you can refine the search to your local office which will show a spreadsheet to compare people from your particular office and the dates they filed to there biometrics to there interview and everything else

Thanks Moslund, that's helpful. For some reason my local office isn't listed - I'm in Long Island and the local office is Holstville but I don't see it on the dropdown list.

You made me nervous, when you said that you used the delivery confirmation! :D I didn't and I really don't know if they got it or not..

I really wonder how it works with the EAD though.. I'm getting mine this week hopefully! It's weird that someone has it and someone doesn't..
