Hi All,

I am not sure if the rest of you all are still facing the online case status issue, but my case status online is still not working.

Hoping to hear from the fellow visa-journey members on this.

They have not been updating for 2 or 3 weeks in some cases. Doesn't mean that things are not processing. After waiting several weeks with no online status change we finally received the I-797C in the mail for the I-765. They appeared to be matching up the biometrics done with the case and the application. Letter said the case was going for background check. Frustrating I know... But the more patient you can be the better.

I am a little worried because I came home with my form I-797C (the appointment letter), which they signed and stamped.

Was someone at the office supposed to keep that form, or is it okay that I left with it?

We sent our application package 3/29/2016 and received email and text april 11,2016 that they accept my package and payment..I received mail from uscis for my biometric appointment, notice of date april 23,2016 and i had my biometrics may 12,2016

But after that i havent receieve mail or text from uscis for whats next

My mail also that had a stamp when i had my biometrics is with me also..The girl did my biometrics gave it to me and said receipt

We had ours on the 11th of May and it was stamped with a red stamp, filled in with in by handwriting and also sent home. No worries. It's all good. Same happened here.

So finally my case moved forward...a step back though but that's fine I was kind of expecting it...Yes it was for I-864 well here are the three things they pointed out...

1. The petitioner/sponsor on Form I-864, Affidavit of Support, must submit a complete Federal income tax return submitted to the Internal Revernue Service (IRS) for the most recent tax year.

2. The petitioner/sponsor lists their current income on Form I-864 as an amount to be considered as sufficient: however, no evidence has been submitted as proof of current income.

Submit evidence of petitioner/sponsor's current income. Such evidence should include :

1. Pay Stubs or other documentation of pay for the previous 6 months.

3. The petitioner/sponsor's household member on Form I-864, Affidavit of Support, must submit a complete Federal income tax return submitted to the Internal Revernue Service (IRS) for the most recent tax year.

Now for point 1 and 3, at the time of sending the package we hadn't done our taxes so just send out the W2 along with the application, I guess it didn't work. So this time I will send out the tax forms that we send out to IRS.

My Wife (petitioner in this case) works on commission basis for an eye lash studio so doesn't have either a solid paystub nor an official offer letter. I am wondering how this can be compensated for, She does have a receipt like looking paystub which I can probably use and she can ask her employer to print her an offer letter with details like the date of joining, position, hours of work ,wages etc etc.

Also will I have to send the whole I864 package again or just the documents asked here.

4th April'2016- Received 4 Text SMSs and 4 E-mails from the USCIS notifying my case has been received and routed to National Benefits Center for Processing. (day 6)

5th April'2016- Checks have been cashed. (day 7)

29th June'2016- Card was mailed to me at the mentioned date(day 84)

2nd July'2016- Card received in mail (day 87)

9th August'2016- Interview scheduled for September 13th(day 125)

13th September'2016- Attended the interview and was told my file wasn't available at the local office. (Day 163 )

29th October'2016- Rescheduled the interview for December 1st. (Day 209)

1st December'2016- Judgement Day RELOADED!(Day241)

I got almost the same RFE due to not sending the 2015 tax return for the same reason as you.

We returned the whole I-864 part of the AOS package in response to the RFE, just so there was no possibility for them to say they didn't have the rest of the supporting documents. And by that I mean we filled out a new I-864, included 2015 tax return, my husband's birth certificate and so forth.

In regards to your wife, I would definitely have her employer write up such a letter you're suggesting, this should show her current income, her title, how long she has been with the company and it should definitely mention and explain the commission thing.

In regards to the paystubs, you could send the thing you're talking about that kind of looks like a paystubs. We sent 12 paystubs in our RFE response (6 in the original packet). Since you don't have "real" paystubs, I would include 6 or 12 months of bank statements as well to show proof of income coming in and out of her bank account. This should support the tax return.

That's probably actually a good thing! :) The estimate for people getting their EADs seems to be about a month after their Biometrics. If you would have gotten a RFE you would probably have gotten it by now. My RFE was dated 3 days after my Biometrics... So I think you're in a good - but unnerving of course - situation :)

Hi, All!

I am still waiting for my Bio Appointment Letter here. Day 35. Today I got tired of my inner-frustration and decided to speak with a Tier 2 ISO at USCIS.

I think the planets aligned for me today as the Tier 1 representative didn't fight too much about it. After waiting for a call back, a very nice officer asked for several contact questions and then wanted to know the reason for my call. I told him about my case.

He told me that California offices are overwhelmed and experiencing known delays, that my case hasn't even been scheduled for an appointment yet, and that they won't start processing my file until Biometrics are done, so there's no RFE pending or anything. Also asked him about checking my status online, and he said that that's a computer glitch and that it may or may not work, and that there's nothing to do about it. Advised me to call them every 30 days for status updates and ALWAYS ask for a Tier 2 rep... Lastly, he told me that I should get the appointment letter within 2 weeks from today, and that if I don't, to call them back to submit a service request.

I am still kind of sad and frustrated, but at least I know there's nothing wrong with my case (well..., yet) and that no letter was sent and lost in the mail, which was a huge relief.

So anyway... Feels like I'm the last April filer experiencing this kind of delay :cry:

I got almost the same RFE due to not sending the 2015 tax return for the same reason as you.

We returned the whole I-864 part of the AOS package in response to the RFE, just so there was no possibility for them to say they didn't have the rest of the supporting documents. And by that I mean we filled out a new I-864, included 2015 tax return, my husband's birth certificate and so forth.

You answered most of my other question within the same answer....I was wondering if I should send only the things they ask for. However, I know a place where I made a mistake in the form 864 but somehow the RFE bypassed it and send me other requests but now I dont want them to come back to me with that error later. That means sending 864 back which in turn means sending all the supporting documents back haaaa!!! I think I'll just send the whole stack of 864 back wouldn't be much.

She has been working barely for about 10 months but I have all her paystubs so will send those and she asked her employee to give her an offer letter with the details, should pack it and send it before the long weekend happens!!!

Your two cents are worth thousands for me :)

That's probably actually a good thing! :) The estimate for people getting their EADs seems to be about a month after their Biometrics. We have the same timeline....exactly the same actually....Hopefully not but if something on the lines of RFE does happen to you like me its in the next couple of days...I received mine yesterday...Again hopefully you wouldn't have to hear anything related to RFE but about a month later maybe about things getting approved!

We have the same timeline....exactly the same actually....Hopefully not but if something on the lines of RFE does happen to you like me its in the next couple of days...I received mine yesterday...Again hopefully you wouldn't have to hear anything related to RFE but about a month later maybe about things getting approved!
