went to the dmv yesterday , but can't get drivers license without GC ?

It's strange how every state works differently :( I got my driver's license once I had SSN, no EAD, no GC. Sorry to hear that!

is that how the things are done in your dmv?

cause mine here in NJ works like this: you need to be LEGAL resident to get a drivers license. So as long as you have a work authorization, you may go and get a driver's license.

this is what google says about MT (took from your local office which may be in a different state but still)

To apply for a new driver's license, you must visit your local Montana MVD office and:
  1. Surrender your out-of-state driver's license, if you have it.
  2. Show proof of your identity, residency, and legal U.S. presence. ...
  3. Pass the written permit test and driving tests. ...
  4. Pass a vision test.
  5. Have your photo taken.

from what is whitten above all you'll have to have your passport or a photo ID, then some letters or bills that show that you reside in this state, and your employment authorization card, cause this will prove you are legal here.

The other thing I learnt from talking to these governmental clerks, is that YOU MUST GO TO TALK TO THEM PREPARED AND KNOWING WHAT YOU NEED TO HAVE IN ORDER TO OBTAIN SMTH FROM THEM

so this is how it works. You make sure you have everything needed to get a drivers license (wait for your EAD) and go there take the test or whatever.

Cause again they usually just want to get rid of you and will tell you a bunch of misleading sh*t

for me to changemy name on my SS card I was told I had to go back to my home country, change my passport there so that it would reflect my married name, and only then come back and change my SS card. Which is ridiculous, cause the only things they need is again my SS card, my marriage certificate and proof of my legal presence in the US.

Don't listen to them, TELL them WHAT they MUST do.

Exactly!! The people didn't have a f***** clue what they're supposed to do, so I brought them all the papers. I had to bring my I-94, proof of my address and then just passport, SSN..

I live in a small town, so not many foreigners here. So you really have educate yourself on this!! And get what you want! :)

Exactly!

Hence unless you have a complicated case it's no use hiring a lawyer for this process in my opinion as countless stories I hear is of couples correcting their legal council on what to do next.

In other circumstances I have increasingly found that I really need to have full knowledge of what it is I want and how to get it because you never know if the employee you face actually knows what they are doing or knows the rules!

I have come across this tooooo many times for it to just be an accident!

Regarding DMV, the law just changed was it last year that all the illegal immigrants are now eligible to apply for ID's or DL here in California at least. (And LAMetro announced how less people are now using Metro services due to be able to apply for DL's :) )

I only know this because of my friends friend is in country illegally and I asked him what did he needed for it. His reply was: "just somenthing with your address in it." :)
And since I am (and all of us) are on AOS etc. we are not in the country illegally it should be ok. Prob depends on the officer.. Haven't tried my luck because of well...

editeditedit

According to good old Google it is only 10-13 states that allows illegal immigrants to apply for DL's: California, Colorado, Connecticut, Delaware, District of Columbia, Hawaii, Illinois, Maryland, Nevada, New Mexico, Utah, Vermont, Washington,

Thanks everyone for your input regarding drivers license. I went to the dmv in iowa ( where my husband is from and we both get stuff in the mail here also..) .

in montana you have to have at least ead, etc; i-797C is not enough.

I had a license when i worked in texas, years ago. That was easy, only needed ssc and workvisa.

april 1st: sent i-485 to chicago lockbox

april 4th: i-485 delivered to chicago lockbox

april 7th: "biometrics fee received and accepted"

april 10th: email notification of acceptance and routing to NBC for processing

april 11th: hardcopy i-797C in mail (notice date april 8th)

april 30th: received biometrics letter for: may 11th @ 9am

june 2nd: received interview letter for: july 6th @ 11.10am

july 6th: Interview day---no decision was made

july 13th: sent e-mail to congressman, asking for an inquiry on my case.
